DEPARTMENTALISATION OF GRAMIN DAK SEVAKS (GDS)  AND INCLUSION OF GDS UNDER 7TH CENTRAL PAY COMMISSION.

FIRST HEARING OF THE COURT CASE ON 7TH MAY 2014

 HON’BLE DELHI HIGH COURT ISSUED NOTICE TO THE GOVERNMENT AND DEPARTMENT OF POSTS.
          As already reported the Hon’ble Delhi High Court has issued notice to Government and Department of Posts in the Writ Petition filed by NFPE & AIPEU-GDS (NFPE) in the Hon’ble Supreme Court of India which stands transferred to Delhi High Court for grant of Civil Servant status and inclusion of GDS in 7th Central Pay Commission.  Next hearing of the case is posted for 7th May, 2014.  In the Writ Petition filed by NFPE & AIPEU-GDS (NFPE) following are the main prayers:
(1)     Give direction to the Government of India and Department of Posts to grant Civil Servant Status to GDS as per the 1977 Supreme Court Judgement and grant all the benefits of the Departmental Employees.
(2)     Include GDS under the purview of 7th CPC.
(3)     Quash the GDS conduct & Engagement Rules 2011.
          Government of India, Department of Posts shall have to file its reply in the High Court.  Now the files have started moving in the Directorate and                DOP&T.
Recognised GDS Union (Mahadevaiah) has no role to play:
          Recognised GDS Union (Mahadevaiah) has already signed an agreement with the Department of Posts accepting separate committee for GDS and accordingly Government has EXCLUDED  GDS from the purview of the terms of reference of the 7th Central Pay Commission.  NFPE & AIPEU-GDS (NFPE) is fighting both organisationally and legally for Departmentalisation and for inclusion of GDS under 7th CPC.
          Shri. Mahadevaiah wrote in his journal (April 2014 Issue) and website supporting separate committee for GDS and claimed that separate committee is better than 7th Pay Commission.  In his journal and website he wrote as follows:
          -  One man GDS committee more independent than a judge heading a pay commission with other members” (!!!!).  Thus Shri. Mahadevaiah has fully justified separate committee for GDS and he claimed that he has signed a “respectable agreement” by accepting separate one-man committee!!
          Let Shri.Mahadevaiah and his Recognised GDS Union support the Government and Department of Posts, by cheating three lakhs GDS by signing their “ death warrant ” in the name of “ respectable agreement”.  NFPE & AIPEU-GDS (NFPE) will not compromise with the Government and shall continue its struggle both legally and organizationally.

SHRI MAHADEVAIAH DON’T WANT THE SUPPORT OF
 DEPARTMENTAL EMPLOYEES

            Shri.Mahadevaiah, General Secretary of the recognised GDS Union has requested the Department of Posts NOT TO ALLOW other Federations and Unions to take up the issues relating to the Gramin Dak Sevaks.  As Shri. Mahadevadevaiah has helped the Government and Department by accepting separate committee for GDS, the Department accepted the request of Shri. Mahadevaiah and issued orders.  It shows that Shri Magadevaiah don’t want the support of Departmental employees who are members of NFPE & FNPO.  NFPE & / AIPEU-GDS (NFPE) believes that the GDS demands can be achieved only with the full support and joint struggle of both GDS & of the Departmental employees. 
          This is the difference between the recognised GDS Union (Mahadevaiah) and AIPEU-GDS (NFPE).  LET THE GDS employees decide which union stands for the cause of GDS.

ALL GDS& DEPARTMENTAL EMPLOYES  BE READY TO FINISH THE RECOGNISED GDS UNION IN THE NEXT MEMBERSHIP VERIFICATION
          Recognition is not a licence to cheat the GDS employees.  Recognised GDS Union has signed an agreement with the Department accepting separate committee and thus admitting that GDS are not civil servants.  Thus recognized GDS Union’s role is over and it has no role to play hereafter.  NFPE & AIPEU-GDS (NFPE) is challenging in the Delhi High Court the stand taken by the Department of Posts and the Recognised GDS Union (Mahadevaiah). 
          NFPE & AIPEU-GDS (NFPE) calls upon all GDS Departmental Employees be ready to finish the “Recognised GDS Union” in the next membership verification.  We are sure that AIPEU-GDS (NFPE) shall become the NUMBER ONE  recognised GDS union in the next membership verification with flying colours. Days are not far away.

About Rule 38 Transfers


Rule 38 transfers may be permitted on the basis of declared vacancy i.e. direct recruit may be transferred against direct recruitment vacancy and promotee against a promotion vacancy. Further OC candidate should be transferred against OC vacancy, SC candidate against SC vacancy and ST candidate against ST vacancy.

(vi) Under Rule 38, inter-Circle and intra-Circle transfer from one distinct cadre to another viz. Post Oflices to Circle Office, Regional Office, SBCO, Postal Assistant to Sorting Assistant etc, or vice versa is not allowed. 

(vii) Only such officials who have put in minimum service of five years in the case of direct recruits in the cadre in question and three years in the case of surplus qualified officials wherever applicable would be eligible for transfer under Rule 38. Any relaxation in this regard should be matter of rarest exception. Transfer of officials who have not yet cleared the probation period should be permitted in deserving cases only.

(viii) Under the existing instructions, Heads of Circles i.e. CPMGs are fully empowered to permit such transfers with the approval of CPMG of the other Circle, where the transfer is sought. ln such cases where the prescribed conditions are met the approval of the Direciorate's would not be necessary.

(ix) As and when the applications are received for such transfers, it should be recorded in the register, which will serve as pr,iority list to be operated as and when vacancy (ies) arise.

(x) L-fnden R.ule 38, an official will be allowed to seek tnansfer ontrv twiceduning-his entire service.

Important Instructions for candidates appearing in tomorrow's (27 April 2014) PA/SA Exam


1.  Candidates are requested to appear for the written test at the Centre on the date and time specified. Candidate should reach the test centre 60 minutes before the commencement of the examination. Candidates are permitted up to 15 Minutes after the commencement of the examination but however they are not permitted any extended time.

2.  Bring Admit Card in ORIGINAL to the examination centre. Keep a photocopy of the Admit Card with you for future referenceYou are required to put your Signatures on the Admit Card in the given box ONLY in the presence of Invigilator in the examination hall and it will be collected during the examination.

3. Admit Cards will not be issued at the Examination Centre under any circumstances. Printout of Downloaded Admit Card from the websitewww.pasadrexam2014.in are valid. Candidates will not be permitted without valid admit card.

4. Please ensure that you bring only ball point pen of colour Black or Blue for marking the OMR Answer Sheet. Marking with “gel” or any other type of pen is NOT allowed.

5. Answer Sheet is of OMR (Optical Mark Recognition) type. For every question there is only one Correct Option. Darken the appropriate Circle to indicate the Correct Answer. Please note No Change is permissible once marked. Applicant who darken more than one circle for any question can’t be valued and rejected. DO NOT put any stray marks anywhere on the answer sheet. Rough work may be done on the blank space in your question booklet. There is “No Negative Marking”.

6. OMR answer sheet has two copies. Do Not separate them. Impressions marked on the Original Sheet will automatically get transferred to the Copy. Original copy will be used for Result Processing. After completion of exam & before leaving the examination hall Candidate is to handover the ORIGINAL copy to the invigilator and candidate may retain Carbonless Copy. It is the responsibility of the candidate to handover the ORIGINAL OMR Sheet to the room invigilator before leaving the examination hall. Question Booklet is allowed to be retained by the candidate.

7. Candidates are not allowed to carry any papers, note books, books, calculators, etc. into the examination hall. Any candidate found using or in possession of such unauthorized material or indulging in copying or adopting unfair means will be summarily disqualified.

8. The duration of Paper is 120 minutes.

9.  Visually Impaired (PH-I) candidate is requested to bring “Scribe” at his/her own cost. The scribe should carry an ID Proof. Scribe should read the Questions in low voice and mark the options as told by the candidate. It should not disturb other candidates in the room. Any misconduct by the scribe/ or candidate himself shall be treated to have been done by that candidate and shall lead to cancellation of the candidature of the candidate. Visually Impaired (PH-I) candidate will allowed 40 minutes compensatory (extra) time for completing the examination.

10. Candidate will not be allowed to leave the examination hall till the examination is over.

Expert Committee Regarding New Capital for Successor State of Andhra Pradesh Constituted


The Centre has  constituted the following Committee known as the Expert Committee to study the various alternatives regarding the new Capital for the successor State of Andhra Pradesh and make appropriate recommendations in pursuant to the Section 6 of the Andhra Pradesh Reorganisation Act, 2014: -


a)         Shri K C Siva Ramakrishnan, IAS (Retd.), Research Professor & Chairman, Governing Board, CPR – Chairman
b)         Dr.Rathin Roy, Director, National Institute of Public Finance & Policy, New Delhi
c)         Shri Aromar Revi, Director, Indian Institute for Human Settlements, Bengaluru
d)         Prof.Jagan Shah, Director, National Institute of Urban Affairs, New Delhi
e)         Prof. K T Ravindran, Former Dean School of Planning and Architecture, New Delhi

 The Terms of Reference of the Committee are as follows:

1. To study various alternatives for locating the new capital of the successor State of Andhra Pradesh and evaluate their comparative suitability based on available data, site visits and consultations with the stakeholders, central government and the existing government of Andhra Pradesh and the successor State of Andhra Pradesh and submit its report within 31st August, 2014.


2. To evaluate the possible alternatives and make appropriate recommendations based on the following considerations:
a) Availability of sufficient land, water and other essential natural resources with due regard to the possibility of de-reservation of degraded forest land.


b) Conduct an assessment of the potential for planned growth for the estimated population with appropriate zoning regulations as well as the feasibility of accommodating large structures to house the Raj-Bhawan, State Legislature (Assembly and Council), Secretariat, High Court, office buildings, guest houses, residential quarters and physical infrastructure including stadia, conference halls, convention centres, hotels, hospitals, schools, colleges, educational and training institutions, libraries, museums, theatres, places of recreation and tourism, parks and markets etc.


c) Potential for connectivity by rail, road and air with various districts of the successor State of Andhra Pradesh and the present common capital of Hyderabad and other major cities of the region as well as the possibility to develop rapid mass transit systems within the city.


d) Assess the potential for developing a vibrant economic, social and cultural infrastructure for a symbiotic growth with the other important cities in the region.


3.         The Committee while making its recommendations will inter-alia consider allied issues such as: a) The least possible dislocation to existing agriculture systems as well as ensure minimum resettlement of people and their habitations. b) Preservation of local ecology and natural features including water bodies. c) Promoting environmentally sustainable growth coupled with measures for pollution mitigation including solid and liquid waste management. d) Vulnerability assessment from natural disasters like floods, cyclones and earthquakes. e) Assess the scope for minimizing the cost of construction and acquisition of land f) Ascertain the availability of raw materials, skilled and unskilled labour etc. required for the construction of a new capital.
