MADRAS HIGH COURT QUASHES THE CHARGE MEMO ISSUED TO TWO STATE BANK OF INDIA (SBI) OFFICERS

While quashing the charge memo issued to two State Bank of India (SBI) officers alleging misconduct for holding a lunch hour demonstration in August last year, the Madras High Court has held that a mere peaceful demonstration, per se, inside the campus, cannot be understood as a mark of misconduct under the rules.

A Division Bench comprising Justices Chitra Venkataraman and K.B.K.Vasuki passed the common judgment on appeals filed by two officers of the bank against a single Judge’s order of February 8 this year.

The two, D.Thomas Franco Rajendra Dev, Deputy Manager, SBI, RBU, LHO, Chennai and D.Suresh Kumar, Chief Manager, RBU, LHO, Chennai, were the general secretary and elected president of the All India State Bank of India Officers’ Association respectively. The association held a lunch hour demonstration on August 28 last year in front of the local head office and in all the administrative offices of the bank. Members, including the two officers, participated.

In September last year, the two were issued charge memo for alleged misconduct under the bank’s officers’ service rules.

They filed writ petitions contending that registered trade unions had a right to demonstrate peacefully. The right flowed from Art.19 (1) ( c ) of the Constitution. They denied that they instigated the officers of the bank to hold the demonstration. There was no misconduct.

A single Judge rejected the writ petitions, holding that the court could not interfere at the stage of charge memo on the basis of the defence pleaded by the petitioners. Aggrieved, the two filed the present appeals.

Colour Of Golden Smile :

Ramcharan afraid of because it was too late. It’s about 10.30am. Sub Postmaster Das da must rebuke him. Ramcharan joined in that double hand Sub post office as PA just six months ago. He used to attend office by public Bus from his home village regularly which is about 33 km away. Some time as there was no other way of Transportation if any damage occurred of the Bus then obviously he reached office late.

“Ramcharan , do you have any problem on road ?’’ SPM Das  said to him on his arrival to office. Already SPM Das started functioning in the counter works.
“Das da , on  road the Bus got some engine problem . So I am late today .” Said Ramcharan. SPM Das handed over the counter works  to Ramcharan and  started his regular works. There was Quee in counter for about half an hour. Ramcharan started working hard and the Quee got ended. After complete of BO Summary works Spm Das started works like dispatch , mail etc. Actually the day was Monday so there were queue in counter.
“ O Subas , where are you?”- called SPM das to GDS Packer man Subas.
“ Yes sir , I am here.” –told Subas.
“ Today lots of works . My engine will fail if not have one peg of wine. Subas, please bring one Half bottle of DS from market.’’ Subas went away to market for SPM’s wine. Ramcharan looked , the mater is not good. Having wine during office hours is so bad habit. In PTC it was learnt not to have drink during office hours which is punishable. But SPM Das da is too senior to him. But yet he told to Das da, “ Das da, will you take wine in office ? You should take in home with masti.’’
“ What happen Ramcharan ? Nothing to be worry . Do you know without one peg my engine will fail today.’’ SP M das da added.
            SPM Das took some pegs in near tea shop. After some time he seems to be like a young man. As if he will perform all office works, why needed another hand in the office ? But where he will hide the age? His eyes become red and started to speak unwanted in the office. Das felt uneasy. There was a bench inside room of the office . SPM das used to sleep a while in that bed.  Actually such kind of happening was regular in that Post office. Ramcharan always asked not to have drink in office hours . But always in vain, no change of SPM Das in drinking.
            After office hours all left office. Ramcharan asked , “ Das da, will you be able to go home alone ?’’
“ don’t   mind Ramcharan,,  ha ha—don’t mind,, nothing happen – I will go some how- ha ha..’’
What to do Ramcharan ?  How he would teach SPM das da ? no answer with him. He left for the last Bus.  Sometime Das da said-he must give up  drinking – must – but when ?

            Days going gradually. One day Ramcharan went to home of SPM das da. He wanted to know about family of him. That was a nice Sunday. Das da and his family were much delighted seeing Ramcharan in their door. Das da called at once to his wife, “Minti, come come , see my colleague Ramcharan coming , what a good day for us ?” . Ramcharan got in to the drawing room and had a glass of water. He introduced with Jimlee , daughter of Das da and Rantu , son . Jimlee was class-V student.
                                                                        
Das da told , “Mr. Ramcharan you have come in right time , I will show you a beautiful thing today .”
“What Das da?” – asked Ramcharan.
“Please wait , don’t mind , I am coming from near market immediately  . Please be seated, you must have day food today here .” Das da went away for market. Ramcharan thought a while –what beautiful thing he wants to show ??
“ with one son & daughter – a happy family, but the unexpected drinking habits make our home like the hell , how many times we request him to give up such habit , but all are in vain, no fruitful results . Can not you say him something to avoid wine ?” –said with sorrow Mrs. Das to Ramcharan. “Madam , we always try , but failed a lot . Das da always said in positive but do always in negative. Madam, we must try again . ” –told Ramcharan. Das madam prepared light food for Ramcharan. Though Das da said he would come back immediately but it was about one and half hour late. Why so late ? Why ? Ramcharan used to peep through window, yes Das da coming back with a new ladies bicycle , but having some pegs of wine with unstable walking . Looking new bicyle  daughter Jimlee ran to him “-–papa papa – my new cycle –my new cycle- ba ba –ha ha –my new beautiful cycle—” . Jimlee secured highest marks in exam among all students in their school and this new bicycle was gift for his beloved daughter. Jimlee was too joyful and called with laughing to her near friends – “Bablu , Dimpi , my new cycle- my new cycle –”  . With unstable walk Das da came into room and also used to speak , “look Mr. Ramcharan , Look , ----Jimlee my love--ly  daughter , ---how mu--ch she hap--py today ? Look her nic--e laughing ??”   Ramcharan understood –what beautiful thing Das da wanted to show him-the nice beautiful joyous  laughing of Jimlee. Das Madam seeing him drunken one used to rebuke angrily – “what  non-sence  ? Today here in home our respected guest and you are having wine – oh no , what will I do – what will I do ? See Ramcharan , when will he change ? Please don’t mind , please --” . Madam used to cry and sat down at floor.  Ramcharan was  upset what to do now. After a while he said to Das , “Das da , listen. Don’t mind . Though you are senior to me I must say to you . You show me the beautiful thing –the joyous nice laughing of Jimlee on having gift –a new bicycle. But how much time it will remain Das da? Don’t you ever want to see such nice joyous laughing in face of Madam or all members of the Family ? Das da , no late more please , Give up drinking , avoid wine.. then you will look such joyous moments in each of your near and dear. Das da , Understand ?”

                 The hobby of collection and study of postage stamps is popularly known as philately. It was English lady with an unusual fancy who unwittingly started stamp collecting as hobby. She wanted to cover the walls of her dressing room with used postage stamps in 1841. She appealed to the readers to send used stamps through the columns of London Times. Soon the craze for collecting stamps began to spread. M.G.Herpin coined the word philately , literally meaning ‘ a lover of taxation ‘ in the year 1864 andencompasses stamp collecting.

                 The first postage stamp of the world called Penny Black was issued in England in May 1840 as per the suggestion of Sir Rowland Hill and the stamp had portrait of young Queen Victoria. In 1852 by the order of the Governor of Sindh Province  , three stamps label were issued. They were in usage in Sindh Province only. They are known as Sind Dak. The stamps were embossed and depicted the East India Company’s broad arrow.

                 Postage stamps are issued primarily to prepay the charges for conveying articles to their destination. Postage stamps issued by a country reflect the tradition , heritage and wealth of its people as also its flora and fauna. There is no facet of human life , which is not portrayed on stamps and herein lies the secret of universal appeal and great educative potential which stamp hold.

               Stamps have very often been arbitrarily classified but we shall classify them on the purpose of issue into four broad categories. (1) Definitive (2) Commemorative / special (3) Thematic (4) Provisional .

              Definitive stamps are regular stamps issued for day to day use. The definitive series are not changed for long periods like five years or more. They are printed in large numbers and can be reprinted  as per requirements. They are so designed as to incur minimum expenditure in manufacture , storage , distribution and sale.

               Commemorative / special stamps are issued to commemorate personalities , events etc. of national or international importance or to draw attention to special occasions , subjects or functions. These are printed in limited quantities and are never reprinted.

              Thematic Stamps are now being issued and collected in increasing number. Thematic stamp collectors instead of collecting all the stamps of the world, concentrate on stamp having the subject of their choice, such as birds , animals , games and sports , trees ,etc.  They are pictorials , neither printed in sufficient quantities to be called definitive nor are they produced in connection with any personality, place or event to be called commemorative.  The aim of issuing such kind of stamps is to satisfy the demands of the thematic stamp collector and to earn money.

         Provisional Stamps as their name signifies, are issued on temporary basis. Such kind of stamps are issued where there is an acute shortage of some particular stamps or sudden changes in Government, currency or postal rates. Sometimes, old stamps are overprinted and made available in time when there is possibility of delay in printing the new ones.

            The collection of postage has become a universal hobby as also means of profit , since many stamps, especially the rare ones are sold at a very high price. Philately is therefore rightly termed as king of hobbies and the hobby of kings. The collection of stamps has now known to such proportions that there are regular ‘ philately clubs’ throughout the world helping their members to obtain stamps of other countries.

             To enable stamp collectors in India and foreign , the India Post opened Philatelic Bureaux at all State capitals and important cities and philatelic counters at other important cities and towns. Old stamps can also be had from these Bureaux and counters , subject to availability. Philately Deposit accounts can be opened with initial deposit of Rs 200/- at all Philatelic Bureaux / counters and all Head Post Offices to get new stamps , first day  covers , brochures as well as new postal stationery with advertisement.

Some special terms relating to stamp collecting.

  1. Mint- Uncancelled stamps are called  mint stamps. They must be in the same form  as issued by Postal Department. These stamps have gum on the back of them. A few countries issue ungummed stamps.
  2. Used- Stamps , with post office seals, are called used.
  3. Pair- Two similar stamps in one unit are called pair.
  4. Block – When four or more stamps are joined together in square position.
  5. Cancellation or Postmark - To put a stamp seal on the stamp through sometimes  it is done with ink.
  6.  Perforation – Holes on all sides of a stamp are called perforation.
  7. Tete- beche- The pair of stamps joined in different direction from each other.
  8. Watermark- Some kind of mark given on the stamp paper , as Star in India formerly and Asoka pillar now a days. Indian commemorative stamps now being printed on paper without watermark.
  9. Overprint- When some separate words are printed on ordinary or special stamps , they are called overprints as Service on some old stamps.
  10. First Day Cover- It is an envelope with stamp cancelled on the first day of issue.
  11.  Miniature Sheet- A small sheet on which one or more stamps have been printed , specially issued for stamp collectors, though can be used for purposes also. In India , Indipex stamps were issued in miniature sheets
  12. Maxim card- It is a postcard with a big sized copy of a stamp and the related stamp cancelled on the first day of its issue.
  13.  Se-tenant – Stamps of different designs, joined together, are called Se-tenants.
  14. Doctor’s Blade- At the time of printing, some stamps come with some extra ink in the form of lines, bars or dots. Such mistake is called Doctor’s blade.
  15. Traffic Light- Most of the multicoloured stamp sheets are printed with colour marks on the margins of the sheet. This enables the printer to know whether any colour is missing in printing. Such corner stamps with colour symbols are known as traffic light stamps. Several collectors use to collect such stamps.

Misuse of red beacon, siren by VIPs is menace to society: Supreme Court



NEW DELHI: Misuse of red beacon and siren, granted by government to VIPs, is a menace to society and it must be stopped, the Supreme Court observed on Monday, asking the Centre to frame rules to restrict its use to only persons holding constitutional posts.

A bench of justices G S Singhvi and V Gopala Gowda asked the government to impose heavy and exemplary fine on its wrong use and granted two-week time to Centre to respond to it. 


"How can citizens be treated differently," the bench said while referring to the problems faced by people when VIPs with high security cover move in vehicles with red beacon and siren. 



"It is a menace to society," it said, adding such misuse "should be dealt with heavy hands and exemplary fine be imposed". 



The bench was hearing a PIL filed by a Uttar Pradesh resident on misuse of red beacon. 



Earlier, the bench had said the red light has become a status symbol and had said thatpolice personnel, who are put on duty for giving security cover to VIPs, should be deployed for better purposes like making the roads safe for women. 



It had also directed Centre and all the states for giving the list of persons being protected either by the central government or by the state administration. 



The bench had said that it would consider forming a new mechanism for assessing security threat to people on the basis of which protection is given to them.

New banks licences to take some more time: RBI


MUMBAI: Ruling out relaxation in norms for granting new bank licences, the Reserve Bank today said that though it has started the scrutiny of applications, the exercise will take some time.

"We have started the scrutiny of applications. It is quite an extensive work because now, we are looking at corporate groups. The workload is quite heavy in that sense," deputy governor AnandSinha, in charge of banking supervision, told reporters here on the sidelines of a Ficci event. 

Sinha also said that RBI will be setting up an external scrutiny panel after the internal scrutiny is over.
