2. Making PAN Card a Mandatory requirement for opening and operation of Tier II account
Pursuant to PFRDA's earlier circular no PFRDA/2013/1/PDEX/25 dated 11.01.2013 with respect to revised list of Know Your Customer (KYC) documents required for both entry and exit under National Pension System, it has been decided to include below mentioned documents in addition to the acceptable KYC documentation, on the basis of feedback received from various entities registered under NPS:

2. It has also been decided to make submission of PAN Card a mandatory requirement for opening and operation of a Tier II account for all sectors under NPS with immediate effect to ensure compliance with AML/CFT guidelines.
In pursuance of this, all existing Tier II accounts under NPS need to be made PAN compliant. The subscribers would be given a time period of 3 months from the date of issuance of this circular, after which the operation of such account would be suspended till the requirement is complied with.
This is for the information of all concerned. The circular has also been placed on PFRDA website athttp://www.pfrda.org.in and CRA website at http://www.npscra.nsdl.co.in. .

(a) whether English subject is mandatory in the recruitment of examination for the Government jobs in the country;
(b) if so, the details thereof;
(c) whether candidates of rural, poor and lower middle-class, lacking knowledge of English subject, are deprived of these jobs as a result thereof;
(d) if so, whether the Government is likely to take action to do away with the compulsion of English subject for all such examinations; and
(e) if so, the details thereof and the action taken in this regard?

(a) & (b): Recruitment for the Government jobs in the country is made in accordance with the approved rules/schemes framed on the basis of job profile and functional requirements of the posts. Most of such recruitments in the Central Government are made on all India basis and the candidates selected through open competitive examinations are required to serve anywhere in India. Testing of English language either as a language paper or component of General English is prescribed as a part of some of the examinations conducted by the two main recruiting agencies of the Central Government viz. Union Public Service Commission(UPSC) and Staff Selection Commission (SSC) as per functional needs.
(c): No such instance has been brought to the notice of the Government.
(d) & (e): Do not arise in view of reply to (c) above.

Pension Scheme for the employees of Jawahar Navodaya Vidyalayas (JNVs)
Number of various categories of posts in teaching as well as non-teaching categories in the Jawahar Navodaya Vidyalayas..?
Whether persons appointed in JNVs prior to the year 2004 in teaching as well as non-teaching categories are not getting pension after retirement..?
The Ministry has replied to the questions above mentioned in Lok Sabha on 13.3.2013 as under...
"The number of teaching as well as non-teaching categories of posts sanctioned in the Jawahar Navodaya Vidyalayas (JNVs) in the country is given below:-

The employees of JNVs appointed before 01.01.2004 have not been found eligible for the grant of pension under the CCS (Pension) Rules, 1972 as the Navodaya Vidyalaya Samiti (NVS), an autonomous organization, was registered after 01.01.1986, the cut-off date for determining the eligibility of employees of autonomous bodies, for pension under CCS (Pension) Rules, 1972. These employees have been representing for this pension and some sections of them had proceeded on strike with effect from 06.02.2013 for fulfillment of their demands, of which the major demand related to grant of pension. The strike has since been withdrawn with effect from 15.2.2013 after assurances from the Government that all their legitimate demands would be sympathetically considered in a time-bound manner.
The Government has approved the introduction of the New Pension Scheme (NPS) for all the regular employees of the NVS, joining on or after 1.4.2009. Those employees who had joined the Navodaya Vidyalaya Samiti on a regular basis before 1.4.2009, including those appointed prior to the year 2004, shall have the option either to continue with the existing Contributory Provident Fund Scheme or to join the New Pension Scheme".

OFFICE MEMORANDUM
Subject: Proper Monitoring of deputation by the lending departments.
Undersigned is directed to refer to this Departments OM of even number dated the 17th June, 2010 and to say that as per existing instructions no extension in deputation beyond the fifth year is allowed. Further, as per the OM No. 14017/30/2006-Estt (RR) dated the 29th November, 2006, the deputationist officer is deemed to have been relieved on the date of expiry of the deputation period unless the competent authority has with requisite approvals, extended the period of deputation, in writing, prior to the date of its expiry. These instructions were reiterated vide the OM of even number dated the 1st March, 2011.
2. In 56th Report of the Action Taken Replies of the Government on the recommendations/observations contained in the 5th Report on the Demands for Grants (2012-13) of Ministry of Personnel, Public Grievances & Pensions by the Department Related Parliamentary Standing Committee has observed inter alia that policy on deputation envisages mobility of personnel between Departments etc so that the employee as well as the Departments benefit from the process. The tendency of treating deputation as a tool to ensure more comfortable, or even home town postings is required to be discouraged. The instrument of deputation
serves public interest only when there is a rational connection with the qualifications and work experience of the deputationist, and the deputation continues for a reasonable period. This would also ensure that both the
lending as well as the borrowing department benefit from the experience / exposure of deputationist officer.
3. All the Ministries/Departments are therefore advised to ensure that deputations are strictly monitored by lending Government Departments. Requests of the borrowing authorities for no objection to extension of
deputations should be closely scrutinized to curb tendency to allow extensions on extraneous grounds, and overstay.
4. These instructions are in addition to the previous OMs on the subject, and in no way dilute the responsibility of the deputationist and borrowing departments to ensure that the deputationists are relieved in time on completion of their approved tenures.

Whether Service Book of an Employee can be supplied under RTI
This question if gets an answer as ‘yes’ may sound a bit weird and unwarranted in employee’s point of view as nobody would like supply of personal records to public.
Of Course there is sense in employee’s case in this issue as Service book of an Government Employee contains very important information about his/her service including disciplinary proceedings taken against him/her.
More seriously, Service Book of a Government Employee would also contain certain personal information such as nominees, present health status, whether undergone any family planning procedures etc., which could be misused against an employee by unscrupulous elements under the cover of RTI.
However, Central Information Commission has decided in a case recently which came for appeal that PIO to supply a copy of the service record of employee under RTI after invoking Sec.10(1) of the RTI Act to sever all those portions that are exempt from disclosure u/s 8(1)(j) of the Act as personal information.
An Extract of order portion in this case is as follows.
“The Commission however, holds that the Public Authority is obligated under section 4(1)(b) the RTI Act to disclose information related to the service of its employees and is not convinced by Shri D’Costa’s argument that such disclosure will endanger his physical safety as all this information is anyway expected to be placed in the public domain.
The Commission accordingly directs the PIO to supply a copy of the service record of Shri Allan D’Costa to the Appellant after invoking Sec.10(1) of the RTI Act to sever all those portions that are exempt from disclosure u/s 8(1)(j) of the Act as personal information. The information should reach the Appellant within four weeks of receipt of this order.”
The Commission accordingly directs the PIO to supply a copy of the service record of Shri Allan D’Costa to the Appellant after invoking Sec.10(1) of the RTI Act to sever all those portions that are exempt from disclosure u/s 8(1)(j) of the Act as personal information. The information should reach the Appellant within four weeks of receipt of this order.”
Though CIC ruling contains a rider for safeguarding private information of a Government employee out of purview of RTI, officials who actually supply information under RTI may find it difficult to differentiate between public and private information related to an employee. In the process, RTI information seeker with profit or malicious motive could sneak in with private information of Government employees.
We hope Government would come up with a meaningful classification of public and private information of a Government Employee and notifiy the same for effective implementation at lower level, which could find an effective soultion to this issue
