3% quota must for disabled in all government jobs - Including Promotional Post
The Supreme Court today held that three per cent reservation for differently-abled persons be given in all category of government jobs including in appointments and promotions to IAS while pulling up the Centre for "frustrating" the very purpose of empowering legislation by opposing it.
A bench headed by Chief Justice R M Lodha said the disabled persons have not got their due in the last 19 years after framing of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, which was passed in 1995.
Additional Solicitor General Pinky Anand, appearing for the Centre, contended that reservation cannot be given in case of promotion to Group A and Group B officers category as it is not a case of appointment.
The bench, however, observed that appointment is a broader concept and the Centre is giving a narrow interpretation of it.
"You are frustating the very reservation policy and cause of class for which Parliament passed the law," the bench said.
"For the last 19 years it is not being implemented and the class, for which the legislation was made, had not got benefited as it should have," the bench said.
The court dismissed the petition of Centre challenging order of Bombay High Court which had directed the Centre and the Union Public Service Commission to implement a 3 per cent quota in direct recruitments and promotions for the disabled in the IAS.

Donate generously to the Prime Minister's National Relief Fund
Prime Minister Narendra Modi made a fervent appeal to all the citizens to donate generously to the Prime Minister`s National Relief Fund today. He made an appeal to all fellow countrymen to stand in solidarity with distressed flood-affected people in Jammu and Kashmir and be part of the national effort to support them in this hour of crisis.
The full text of the appeal is as under:-
"My Fellow Citizens, You are all aware that unprecedented floods have caused havoc in the state of Jammu and Kashmir. A large number of persons have died or have been temporarily displaced. Property and infrastructure worth crores of rupees have been damaged. Our fellow countrymen in Jammu and Kashmir need our help at this critical hour to tide over the calamity and to rebuild their lives.
The Central Government is extending full cooperation to the Government of Jammu and Kashmir in the measures for rescue, relief and rehabilitation besides, direct assistance to the affected people. I request all fellow countrymen to stand shoulder to shoulder with our distressed brothers and sisters in Jammu and Kashmir and be part of the national effort to support them in this hour of crisis.
I appeal to all citizens to donate generously to the Prime Minister`s National Relief Fund."

As per directions on the subject the nationalized banks will not charge any commission on preparation of drafts favouring the PMNRF.

A Delegation of NFPE Leaders consisting Coms. R.N. Parashar, Secretary General , NFPE , Giriraj Singh General Secretary R-III and R. Seethalaxmi General Secretary P-IV met newly appointed Member(P) Shri Ashutosh Tripathi and Member (O) Shri John Samuel on 15t September, 2014 and greeted them on their promotion and discussed various issue related to staff matters e.g. Cadre Restructuring , Postmen related issue, RMS issues, posting of Director Shilong and Agartala , casual labourers wage revision, inclusion of GDS in 7th CPC etc. Both officers responded positively on all issues.
Member (O) informed that meeting with both Federations (NFPE/FNPO) will be organized soon to discuss all the issues in detail.

Government may amend law to clear cheque-bounce cases soon
The government is likely to introduce long-pending amendments to the Negotiable Instruments Act, 1881, in the next session of Parliament as part of steps being taken to unclog the huge backlog of cheque-bouncing cases in the country's courts. The amendment bill proposes the use of alternative ways to resolve disputes, lays down the procedure to be followed in such cases and suggests making electronic transactions free of cost to promote their use.
"The department of financial services has finalised these amendments and the bill is expected to come up in Parliament in the next session," said a senior law ministry official.
The matter was brought to the notice of the law minister in the advisory council meeting on August 26, he added. The Negotiable Instruments Act was amended in 2002 to make cheque bouncing a criminal offence. The proposed amendments could help to reduce the pendency of cheque-bouncing cases under section 138 of the act, which provides for prosecution.
The amendments have been framed on the basis of suggestions made by an inter-ministerial group set up in 2012 to look into policy and legislative changes to curb the increasing number of cheque-bouncing cases. As per government data, more than 3.8 million cheque-bouncing cases have been pending in various courts as of 2011.
Once the changes in the act are effected, all such cases will have to be decided through an alternative dispute resolution mechanism — arbitration, conciliation or settlement. The department of financial services has also finalised a procedure to deal with cheque bounce cases, said the official. The proposal to amend the act was first moved by the law ministry in 2011 as a part of a pendency reduction drive. Early this year, the Supreme Court issued guidelines for the speedy disposal of cheque bounce cases.

OFFICE MEMORANDUM
Subject : Grant of Non-Productivity Linked Bonus (ad-hoc bonus) to Central Government Employees for the year 2013-14.
The undersigned is directed to convey the sanction of the President to the grant of Non-Productivity Linked Bonus (Ad-hoc Bonus) equivalent to 30 days emoluments for the accounting year 2013-14 to the Central Government employees in Groups ‘C’ and ‘D’ and all non-gazetted employees in Group ‘B’, who are not covered by any Productivity Linked Bonus Scheme.
The calculation ceiling for payment of ad-hoc Bonus under these orders shall continue to be monthly emoluments of Rs. 3500/-, as hitherto. The payment of ad-hoc Bonus under these orders will also be admissible to the eligible employees of Central Para Military Forces and Armed Forces. The orders will be deemed to be extended to the employees of Union Territory Administration which follow the Central Government pattern of emoluments and are not covered by any other bonus or ex-gratia scheme.
2. The benefit will be admissible subject to the following terms and conditions:
(i) Only those employees who were in service as on 31.3.2014 and have rendered at least six months of continuous service during the year 2013-14 wIll be eligible for payment under these orders. Prorata payment will be admissible to the eligible employees for period of continuous service during the year from six months to a full year, the eligibility period being taken in terms of number of months of service (rounded off to the nearest number of months).
(ii) The quantum of Non-PLB (ad-hoc bonus) will be worked out on the basis of average emoluments/calculation ceiling whichever is lower. To calculate Non-PLB (Ad-hoc bonus) for one day, the average emoluments In a year will be divided by 30.4 (average number of days in a month). This will there after be multiplied by the number of days of bonus granted To illustrate, taking the calculation ceiling of monthly emoluments of Rs. 3500 (where actual average emoluments exceed Rs. 3500), Non.PLB (Ad-hoc Bonus) for thirty days would work out to Rs. 3500×30/304=Rs.3453.95 (rounded off to Rs.3454/-).
(iii) The casual labour who have worked in offices following a 6 days week for at least 240 days for each year for 3 years or more (206 days in each year for 3 years or more in the case of offices observing 5 days week), will be eligible for this Non-PLB (Ad-hoc Bonus) Payment. The amount of Non-PLB (ad-hoc bonus) payable will be (Rs.1200×30/30.4 i.e.Rs.1184.21 (rounded off to Rs.1184/-). In cases where the actual emoluments fall below Rs.1200/- p.m., the amount will be calculated on actual monthly emoluments.
(iv) All payments under these orders will be rounded off to the nearest rupee.
(v) The clarificatory orders issued vide this Ministry’s OM No.F.14 (10)—E. Coord/88 dated 4.10.1988, as amended from time to time, would hold good.
3. The expenditure on this account will be debitable to the respective Heads to which the pay and allowances of these employees are debited.
4. The expenditure incurred on account of Non-PLB (Ad-hoc Bonus) is to be met from within the sanctioned budget provision of concerned Ministries/Departments for the current year.
5. In so far as the persons serving in the Indian Audit and Accounts Department are concerned, these orders are issued in consultation with the ComroIler and Auditor General of India.
