Payments bank licence imminent for India Post If approved, it will be consistent with PM’s plan to use post offices to deliver financial services to remote areas

New Delhi: The grant of a payments bank licence to the India Post is imminent, according to a senior finance ministry official who did not wish to be identified.

If approved, it will be consistent with Prime Minister Narendra Modi’s vision to utilize the existing network of post offices to deliver, in addition to the existing bouquet of postal services, financial services to the remotest parts of the country through digital connectivity and innovations.

India Post has 155,015 post offices across the country, of which 139,144 are in rural areas.

To give a fillip to these existing branches, the department of posts has tied up with e-commerce firms such as Snapdeal and Amazon to deliver parcels—parcel revenue for fiscal year 2014-15 rose 37% compared to a decline of 2% in financial year 2013-14, as reported by the Press Trust of India on 12 July.

“India Post will most likely get payments bank licence as they have a good case,” said the finance ministry official.

On 9 July, communications and information technology minister Ravi Shankar Prasad said that the Reserve Bank of India (RBI) is expected to grant payments bank licence for the operation of Post Bank of India.

The finance ministry official cited earlier also said that post offices as payments banks may also be allowed to accept transactions for others who may be awarded payments bank licences.

The committee on payments banks headed by Nachiket Mor submitted its report last week and the licences are expected to be awarded by the end of August. However, the number of licences that will be issued is still not known.

Mor declined to comment, saying that as the head of the committee he cannot disclose details.

A payments bank can take deposits, allow remittances and offer simple financial products, but will not be allowed to lend. It will have to invest 75% of its funds in government securities and the minimum capital required to set up a payments bank is set at Rs.100 crore.
The central bank, in November, had invited applications for payments bank and small finance bank licences.

In total, 41 applications were received by RBI for payments bank licences, including from Reliance Industries Ltd, Tech Mahindra Ltd, Aditya Birla Nuvo Ltd and Airtel M Commerce Services Ltd, among others.

Shailendra Kumar Dwivedi, director, Post Bank of India, India Post, said that he cannot confirm the development and that he can only talk after the licence is awarded.

“Like everybody else, the minister (Prasad) must have also heard it from some quarters. But given the credentials and readiness of the postal department, it must get the licence,” he said, adding that right now, it is uncertain.

However, Dwivedi added that the department has started the process of engaging with consultants who will help implement and set up the bank as it anticipates the licence.

A representative of a consulting firm with which the department is in talks confirmed that the department is preparing to ensure a quick roll-out once the licence is granted.

The consultant declined to be identified because the firm has signed a client confidentiality clause.

“Since the basic idea is to cover the unserved or underserved to make them included, it should be somebody who has a large distribution network, reach, infrastructure and has prior experience is similar business (financial services), maybe someone like India Post or microfinance institutions,” the consultant said.

India Post already offers financial services under the heads of post office savings scheme, postal life insurance, money remittance service, mutual funds and forex services.

7th Pay Commission Recommendations has begun to emerge!
“It doesn’t come as a surprise that even bits and morsels of information about the recommendations, which is being eagerly expected by nearly 50 lakh employees and pensioners, make headlines.”
The recommendations of the 7th Pay Commission have slowly started to make their way to the media in the form of unconfirmed news. The information that was being extensively discussed by all for more than a week now has finally made it to the websites yesterday.
It has now been confirmed that the 7th Pay Commission will submit is report to the Government next month. With the report being given a final shape, certain pieces of information have already started to hit the media. Some of the workable recommendations of the commission are out.
In 2006, a number of such unconfirmed reports surfaced, when the 6th Pay Commission report was being prepared, because the report was not submitted to the government on time. Due to the delay, there was tremendous curiosity to find out what the report contained. This led to a lot of rumors. Since the internet didn’t become that popular in those days, those rumors were hard to believe. Most of them were circulated by word of mouth.
Now, despite the fact that there are plenty of news sources, since it has become possible to trace the point of origin of the information, such rumors have reduced. This time around, the information was given by the leaders of Federations. Yet, one can neither completely accept them as true, nor dismiss them as entirely false.
Since the government and the major employees federations have their own websites, it has become possible for the information to spread to the corners of the world within minutes. Also, retracts and denials too have become equally fast, thus killing the rumours immediately. With a number of other individual websites and blogs too covering the news about Central Government employees, the readers are now able to differentiate between news and rumours.
There is nothing surprising or shocking in the news reports that have now surfaced. A minimum basic pay of Rs.21,000 is an expected one. The recently released Kerala Pay Commission too has recommended the minimum wage at Rs.17,000 (from 01.01.2014 onwards). The National Council has demanded that it be Rs.26,000 per month.
It is a well known fact that the Grade Pay System had been a source of constant irritation. The dual Hierarchy System (Promotional hierarchy and Grade Pay hierarchy) will come to an end. There will not be any more confusion about the promotions that come through MACP.
The Multiplication Factor of 2.86 does sound very low. NC JCM had pressurized the Pay Commission to fix it at 3.7. The 6th Pay Commission had fixed it at 1.86, and also given Grade Pay. Since the DA now stands at 125% (including July 2015 and January 2016), this could end up being substantial.
Information about retirement is unexpected. Unconfirmed reports claim that the 7th Pay Commission is planning to recommend 33 years in service or the age of 60 (whichever comes early) as the criteria for superannuation. Since the recommendations will be implemented from 01.01.2016 onwards, many are likely to get affected.

Trade unions unappeased after meeting PM Narendra Modi in absence of any concrete assurance

NEW DELHI: There was no breakthrough during Prime Minister Narendra Modi's hour-long meeting with a dozen central trade unions on Sunday. This could make it difficult for the BJP-led government to get some key labour legislations passed in the upcoming monsoon session of Parliament as trade unions are opposing reforms. "The PM just listened to us and did not say anything. There has been no assurance and we will continue with our plan to go for a nationwide strike in September," Gurudas Dasgupta of All India Trade Union Congress told the media.

These include amendment to the EPF & MP Act to give employees an option to park their savings with NPS, amendment to the Child Labour Act, introduction of the Small Factories Act and amendments to the Bonus Act. An inter-ministerial group had earlier in the day indicated that the government is on board with some of the key demands of trade unions, including social security for all and recognition of trade unions. However, it said differences still persist on key issues of contract labour and minimum wages.

"It was a positive discussion and the finance minister has taken cognisance of all issues raised," petroleum minister 
Dharmendra Pradhan had said. Finance minister Arun Jaitley-led interministerial group — comprising labour minister Bandaru Dattatreya, petroleum minister Dharmendra Pradhan, power minister Piyush Goyal and minister of finance Jayant Sinha — met central trade unions on Sunday in the afternoon after which Modi met the unions in the evening. "There are huge gaps on the issues of contract labour and minimum wages," said Dattatreya.

"Prime Minister's inaugural speech at the ILC will determine our future course of actions," said Pawan Kumar of Bhartiya Mazdoor Sangh, a BJP affiliate TU. Unions have condemned the government's move to codify all labour laws, saying it is an attempt to dilute existing laws.

The Prime Minister, Shri Narendra Modi, today met leaders from various Trade Unions, over tea. The meeting followed extensive consultations that these leaders had with an inter-ministerial team headed by the Finance Minister Shri Arun Jaitley, earlier in the day.

The Prime Minister heard the views of the Trade Union leaders on various issues of interest to workers, including in areas related to economic policy, and related laws.

The Trade Unions represented at the meeting included AITUC, All India United Trade Union Centre, All India Central Council of Trade Unions, Bharatiya Mazdoor Sangh, CITU, Hind Mazdoor Sabha, Hind Mazdoor Sangh, INTUC, Labour Progressive Federation, National Front of Indian Trade Unions, Self-Employed Women's Association, Trade Union Coordination Centre, and United Trade Union Congress.

3.  Select details option in View menu on the top of explorer. (View->details). All files will be shown with file type and date modified.

4.  Sort the files by modified date (Click on date modified column once or twice).

5.  Select and cut the oldest zip file(single file) and copy into separate folder on

desktop.( this file might be corrupted).

6.  Start the eMO client application.

7.  Check the eMO after 10-15 minutes. 

After completing the process, wait for 24 hours. Your office eMOs will be automatically processed and information is updated on eMO MIS https://services.cept.gov.in/eMO/  

Check the eMO MIS after a day  

4.      No files pending unprocessed inside data folder (inside RXD)  

Please do the following carefully.  

1.  Stop the eMO client application if running.

2.  Open the data folder Inside RXD Folder of eMO client installation path.

3. Select details option in View menu on the top of explorer.(View->details). All files will be shown with file type and date modified.

4. Sort the files by modified date (Click on date modified column once or twice).

5. Select and cut all the files received on oldest date and time and copy into to separate folder on desktop.( these file might be corrupted).

6. Delete all the files with file type qsq_tmp in data folder of rxd.

7. Start the eMO client application.

8. Check the eMO after 10-15 minutes.  

After completing the process, wait for 24 hours. Your office eMOs will be automatically processed and information is updated on eMO MIS https://services.cept.gov.in/eMO/

            New Delhi: A complainant in sexual harassment case will be allowed three months paid leave and she or the charged central government employee can be transferred to other department during the inquiry, according to Office Memorandum F.No.11013/2/2014-Estt (A-II1) dated July 16, issued by the Department of Personnel and Training (DoPT) in such cases.

            The disciplinary authority has been directed not to dispense with the inquiry in complaints of sexual harassment lightly, arbitrarily or with ulterior motive or merely because the case against the government servant is weak.
            The committees for checking sexual harassment at work place will have the powers to recommend transfer of the aggrieved woman or the charged officer to any other workplace, and to grant leave to the aggrieved woman up to a period of three months. “The leave will not be deducted from her leave account,” it said.
            Complaints committees have been set up in all ministries and organisations under them in pursuance to the judgement of the Supreme Court in the Vishakha case. These committees are to be headed by a woman and at least half of its members should be women.
            “In case a woman officer of sufficiently senior level is not available in a particular office, an officer from another office may be so appointed. To prevent the possibility of any undue pressure or influence from senior levels, such complaints committees should involve a third party, either an NGO or some other body which is familiar with the issue of sexual harassment,” the DoPT said in its instructions.
            The aggrieved woman or complainant is required to make a complaint within three months of the incident and in case there has been a series of incidents, three months of the last incident, it said.
            The complaints committee may, however, extend the time limit for reasons to be recorded in writing, if it is satisfied that the circumstances were such which prevented the complainant from filing a complaint within the stipulated period, the DoPT guidelines said.
            Sexual harassment includes physical contact and advances, demand or request for sexual favours, sexually coloured remarks, showing any pornography and any other unwelcome physical, verbal, non-verbal conduct of a sexual nature.
            Besides, implied or explicit promise of preferential or detrimental treatment in employment; implied or explicit threat about her present or future employment status; interference with her work, creating an intimidating, offensive or hostile work environment for her; and humiliating treatment likely to affect her health or safety may also amount to sexual harassment, it said. .Source :PTI

          IV.            Interference with her work or creating an intimidating or offensive or hostile work environment for her; or
          V.            Humiliating treatment likely to affect her health or safety.

·        What should you do if you experience sexual harassment?

If you experience sexual harassment, take action to stop it.

Speak up at the time: Be sure to say "NO" clearly, firmly and without smiling when you experience sexual harassment as that is the best way to let the harasser know that his or her behaviour is offensive. If you are asked to go places, do things, respond to questions, or engage in situations that make you uncomfortable, say "NO" emphatically and clearly and do not worry about offending the other person or hurting his or her feelings. Objecting to the behaviour when it occurs helps if you decide to file charges later.

Keep records: Keep track of what happens in a journal or diary and keep any letters or notes or other documents you receive. Keep copies of any offensive material at the workplace. Write down the dates, times (including frequency of offensive encounters), places, and an account of what happened. Write down the names of any witnesses.

Every document that you use during trial must be authenticated by a witness. Keep this in mind during your depositions when the defense asks you where you obtained a document. If you are not clear about where you got the document, and who can authenticate it, you will not be able to use it during your trial.

Take all letters of commendation, awards, thanks you's and anything at all that will corroborate your positive job performance. Pay special attention to documents that your superiors have provided lauding you and your work. If possible, ask your clients, staff, and peers for letters of commendation.

Talk to someone you can trust: Being quiet or stoic about sexual harassment lets it continue. Talk to other co-workers, union members, family members or friends whom you can trust. You may not be the only one harassed by this person.

Create a witness: Inform a trusted colleague and try to insure that s/he is an eye or ear witness to a situation where you are being sexually harassed. This will be useful later if you chose to file a formal complaint.

Report sexual harassment to the appropriate person in the organization: Explore the different avenues available to you and file a formal complaint if necessary. If your organization does not have a policy, ensure that your employer formulates an anti-sexual harassment policy and carries out all the connected tasks.

Get a medical check-up: If you have been raped or physically assaulted, go for a medical check-up. Obtain a medical report. This is important, should you decide to pursue a legal case.

·        Can an aggrieved file a civil suit in a case of sexual harassment in the workplace?

Yes, a civil suit can be filed for damages under tort laws. The basis for filing the case would be mental anguish, physical harassment, loss of income and employment caused by the sexual harassment.

·        Under what circumstances can complaints be filed?

Complaints may be filed under the following circumstances:
·        Cases involving individuals from the same organization
·        Cases that concern third party harassment, which implies harassment from an outsider.

·        Where can I file a complaint?

o       Internal Complaints Committee – if you are an aggrieved woman who has a relationship of work with that specific organization
o       Local Complaints Committee – if you are an employee from an establishment where the Internal Complaints Committee has not been constituted due to having less than 10 workers. In the case that the complaint is against the employer himself/herself and the individual feels that the case may be compromised, she can also lodge the complaint in the LCC 
o       For instances where the LCC may not be immediately accessible, the Act instructs the District officer to designate one nodal officer in every block, taluka and tehsil in rural or tribal area and ward or municipality in the urban area, who will receive the complaint and forward it to the concerned LCC within 7 days.
o       Local police station, in case provisions under the Indian Penal Code are applicable.

INSTRUCTIONS:
