Attendance.gov.in: Modi government launches website to track attendance of government employees

Using UIDAI, Prime Minister Narendra Modi-led NDA government has launched a Biometric Attendance System (BAS) for government employees. Attendance.gov.in has been launched to keep a track on the attendance records of employees. 

Under the system, an organisation needs to register on the website. According to the website, "A back-end administrator will check the details of the organisation submitted and make the organisation active by assigning it a unique sub-domain which will be the first name of the website." 
 
Aadhaar number is essential for registering an employee in BAS. The Attendance IDs of employees will be generated from their Aadhaar numbers. The 6 digit number will be generated based on the last 6 or first 6 digits of the person's Aadhaar number. The attendance ID will only be active when the employee's Aadhaar information has been verified by UIDAI and activated by the Nodal officer. 

The employees will be required to enter their 6-digit Attendance ID on the terminal and subsequently the system will ask for finger print verification. The staff will be able to mark attendance in any bio-metric terminal installed in various Central Government buildings. 
Since network connectivity is essential for marking attendance, the government is planning two types of connectivity with each attendance terminal; wi-fi on NICNET/broadband and SIM based GSM connectivity on tablets. 

The system will not only help track the number of registered organisations and employees, but also give a dynamic interface to know the number of people attending office and the count of active devices.

Law Ministry never advised DOP & PW to implement qua petitioners

D/o Pension & Pensioners Welfare has referred this file to examine on the following issues:

(i) The Curative Petition filed in respect of OA No. 655/2010WP(C) No. 1535/2012/SLP (c) No. 23055/2013/Review Petition No. 2492/13 has been dismissed by a Five Member Bench of the Hon’ble Supreme Court headed by Chief Justice of India. Therefore, we may implement the CAT/High-Court order in respect of petitioners only subject to acceptance of this option by the CAT, Principal Bench in the pending Contempt Petition. The implementation of CAT order will be subject to the clarification sought from the CAT and mentioned in Para 2 above.

(ii) We may implement the CAT order in respect of all pre-2006 pensioners subject to the final outcome of the pending SLP No. 36148-50/2013.

(iii) Although the Curative Petition has been dismissed. we may await the outcome of SLP No. 36148-50/2013 before deciding on the question of implementation of CAT order, subject to acceptance of this option by the CAT, Principal Bench in the pending Contempt Petition.

2. It is the case of Department of Pension that the order dated 1/11/2011 (Flag B) passed by CAT in OA No.655/2010 in the case of Central Government SAG Pensioners’ Association v/s UOI and Ors. had acquired its finality consequent to dismissal of Writ Petition (C) No.1535/2012 titled as Union of India and Anr. v/s Central Government SAG Pensioners’ Association and Ors. by the High Court vide its order dated 29/412013 (Flag F). dismissal of SLP No.23055/2013 by the Apex Court on 29/7/2013 (Flag G). dismissal of Review Petition No.2492/2013 by the Apex Court on 12/11/2013 and dismissal of Curative Petition (C) No.126/2013 by the Apex Court vide its order dated 30/4/2014 (Flag K). In these circumstances it is stated that order of tribunal passed in OA No.655/2010 in the case of Central Government SAG Pensioners’ Association (SUPRA) acquires its finality. It is also mentioned in the reference note that a Contempt Petition for implementation of CAT order dated 1/11/2011 is pending before the tribunal and is fixed for 15/5/2014.

3. In other matters wherein the Deprtment have filed SLPs before the Apex Court against the orders of the tribunal and the High Court and those SLPs are still pending and the Hon’ble Supreme Court had recorded the statement given by the Counsel of Respondents that ‘they shall not precipitate the matter by filing contempt proceedings either before the High Court or before the Tribunal’ in its order dated 19/11/2013 (Flag I). In these circumstances there is no possibility for filing any contempt against the Department.

4. Having exhausted all the possible available remedies. the Govt. is left with no other alternative but to implement the order passed by the CAT, which has been upheld by the highest Court of the land. In so far as the pending SLPs are concerned, there may not be any objection in awaiting the final outcome of the cases before taking a final decision.

National Postal Week 9th – 15th October, 2014





World Post Day is celebrated each year on 9th October, to commemorate the establishment of the Universal Postal Union (UPU) in 1874 in the Swiss capital, Berne. It was declared as World Post Day by the UPU Congress held in Tokyo, Japan, in 1969 and since then, it is celebrated all over the world to highlight the importance of the postal services. 

India Post is celebrating National Postal Week from 9th to 15th October, 2014. The purpose of World Post Day is to create awareness about the role of the postal sector in the lives of people and business and its contribution to the social and economic development of the country. The celebration is aimed at generating a broader awareness about India Post’s role and activities among the public and media at national level. 

As part of National Postal Week, Department is celebrating Savings Bank day, Mail Day, Philately Day, Business Development Day and PLI Day to focus on various services provided. 

Department of Posts has been serving every part of the country for more than 150 years by providing mail , Speed Post and Parcel services, Post Office Savings Bank, Postal Life Insurance, Philatelic services by issue of definitive and special/ commemorative stamps. The Department has been providing ‘My Stamp’ service to public at large. ‘My Stamp’ is the brand name for the personalized sheets of Postage Stamps of India Post. The personalization is achieved by printing a thumb nail photograph of the customers of the images and logos of institutions, or images of art work, heritage buildings, famous tourist places, historical cities, wild life, other animals and birds etc, alongside the selected Commemorative Postage Stamps. 

Department is well aware about the changing needs of the customers and has introduced products like Speed Post, Express/Business Parcel, Business Post, ePost, Money Remittance services etc. Utilizing the vast network of Post Offices, India Post offers bill collection under ePayment and retails third party products from Post Offices. 

India Post is providing the service of reservation of railway tickets under Passenger Reservation System of Indian Railways. Around 300 Post Offices are providing this facility to the customers across India. 

India Post has set up Automated Mail Processing Centers in Delhi & Kolkata to create an Automated Mail grid. The Automated Mail Processing Center facilitates the processing of more than 55,000 piece of mail an hour. During the National Postal Week customers, especially children are encouraged to tour Automated Mail Processing Center. This unique venture of India Post is worth visit by the people. 

In tune with the emerging e-Commerce market, parcel product has been revamped & Cash on Delivery (CoD) facility has been introduced. State-of-the-art Parcel centres are also being set up across the country. Department is also developing Parcel Network to cater to the needs of e-Commerce companies. Delivery of parcels and Express mail is also planned to be mechanised in bigger cities for efficient & quicker delivery. 

India Post is in the process of inducting technology through an enterprise wide IT Project, at an approximate cost of Rs. 4909 crores,that will bring in electronic connectivity and capabilities across 1.5 lakhs Post Offices for seamless delivery of all mail & financial services. 

On the occasion of ‘World Post Day’ a seminar on ‘Building Business for India Post’ was organized by Department of Posts to deliberate on opportunities and road ahead for India Post. ‘My Stamp’ facility was also inaugurated by Member (Operations), Postal Services Board in Sansad Marg Head Post Office, New Delhi – 110001. Number of activities have been planned during National Postal Week across the country.

In many countries, philatelic exhibitions are organized and new stamps and date cancellation marks are issued. Other activities include the display of World Post Day posters in post offices and other public places, open days at post offices, mail centers and postal museums, the holding of conferences, seminars and workshops, as well as cultural, sport and other recreational activities. Many postal administrations issue special souvenirs such as T-shirts and badges.
With the support of massive network, the reach of the Postal department is in every corner of the world. The development of postal service took place rapidly in all the areas of the world since 1st half of 20th century. It seems to us that Post is nothing but “The other name of extreme trust” of the common people.
On this auspicious day, it is time to think and work as per the terms of Ex-Communication Minister:
“How we can serve the consumer best, this should be the highest duty of every Post and Telegraph worker. Frugality is essential but it should not be at the cost of work ability.” (3rd May 1971, Hemvati Nandan Bahuguna(1919-1989))
Again according to Gandhiji, “For us every consumer is an important person. He is not dependent on us. We are dependent on him. He is the purpose of our work…We do not oblige him by doing his service. He obliges us by giving us the opportunity to serve.”

Home Ministry raises concern over use of Aadhaar as address proof


The Home Ministry has raised multiple concerns over using UIDAI number as an address proof in the DoT's proposed online verification system, saying the supporting data in Aadhaar may not be authentic or genuine. 

The Home Ministry said that 'Aadhaar' is strong on ensuring unique identity, "however, uniqueness of identity is not a necessary condition to ensure authenticity of identity or genuineness of other entries or records of Aadhaar number", sources said. 

The ministry has written to the Department of Telecom (DoT) sharing its view on accepting Aadhaar as valid proof of address for e-KYC (Know Your Customers) programme. 

The Home Ministry has raised concerns over supporting documents submitted by people as proof of identity and proof of address for getting a Aadhaar number, a source said. 

The DoT is working on proof of concept (e-KYC) to use Aadhaar number for online verification of people seeking mobile connections along with existing process of customer verification. 

Aadhaar card can be also issued to foreign nationals staying in the country, which has also been questioned by the Home Ministry as nationals of neighbouring country may attempt to use it to procure Indian identity documents for infiltrating their agents. 

The Home Ministry has said that unlike Aadhaar, other acceptable proof of address documents such as passport, driving licence do not have the status of universality and therefore "even higher levels of error in these documents may not translate into comparable volume of security concerns". 

It said that Intelligence Bureau is neither aware of back-end systems, e-processing and e-auditing existing in Unique Identification Authority of India (UIDAI), which issues Aadhaar, nor knows how data is transmitted between units of UIDAI and how data are stored. 

The Home Ministry has also raised concern on involvement of foreign vendors by UIDAI for storing data and has suggested audit of data security. 

Sources said that introducer system provision, under which people not having supporting documents as ID and address proof can also get Aadhaar number if he is introduced by a person owning a Aadhaar number, has been questioned by the Home Ministry.

Proactive disclosures under RTI Act

    Every Public Authority must proactively disclose the following:

•    Particulars of the organization, its functions and  duties;

•    Procedure followed  in its decision making process

•    Norms set out for the discharge of its functions;

•   Rules, regulations, instructions manual and   records used by its employees for the discharge of its functions,

•    Arrangement for consultation with or representation by thepublicin policy formulation/implementation;

•   Designate  Publi Information  Officer to  provid information to applicants

•    Also to designate APIO at sub-divisional/district level

•    No bar on the number of suc PIOs/APIOs

•   Designate appellate authority for the first appeal within thepubliauthority

Exemption from disclosures  Section 8(1)

a Information which woul prejudicially affect the sovereignty and integrity of
India
b Information which ha been  expressly forbidden by any  court
c Information  whic would   caus  breac of  privileg of parliament/state legislature
d Information relating  to commercial confidence, trad secrets, thedisclosurwhich woul harm the competitive position of a third party
e)  Information available to a person in his fiduciarrelationship.
f)   Information received in confidence from foreign govt.
g Information, the  disclosure of  whic would   endanger the  lif or physicasafety of any  person
h)  Information which woul impede the process of investigation orapprehension
or prosecution of offenders;
i)   Cabinet papers including records of deliberations of the counci ofministerssecretaries and  other officers.

j)   Information which relates  to personal information, the disclosure ofwhich ha no  relationship to any  public activity or interest,  or whichwoul cause unwarranted invasion of the privacy of the individual

Exemption fromdisclosures Section 8(2)
     Information comes  under official secrets act, 1923

Section 9

    Information  whic would   infringe the  copyright subsisting i person

Section 10  (Severability)

    Where a request for information is rejected vid sections 8/9above, access ma b provided to tha part of the recordwhich does  not contai any    information   which   i exempted   from   disclosur(provided that part ca besevered without causing any  damage to any  part thatcontains exempt information)

Section-11 (Third Party Information)

    CPI intends to disclose, shall giv a written notice to thirdparty within 5 days
     Third party to make representation within 10 days.
    CPI shall make  decision keeping i view  of thesubmission of third party
    However the  information may   b disclosed  i the  publicinterest outweighs the harm or injury to be caused to the thirdparty.
     If he prefer appeal, CPI ha to finalize based on the decisionof the

I the applicant i not satisfied with the  information received or if no information is provided by the PA within the prescribed time limit, heca prefeappeals in followin two stages.

Public Authority is liable to a fine  of Rs 250/- per day subject to amaximum of Rs. 25,000/ for

     Not accepting an application;

     Delaying information release without reasonable cause;

     Malafidely denying information;

     Knowingly giving  incomplete, incorrect or misleading information;

     Destroying information that ha been  requested; and

     Obstructing furnishing of information in an manner.



SIC/CIC ha the power to impose penalty & recommend for disciplinary action
