“‘the matter is beyond controversy after the decision of Supreme Court of India in Gokulanda Das’s case where it has been declared that ‘an Extra Departmental Agent is not a casual worker but holds a post under the administrative control of the State and that while such a post is outside the regular civil service, there is no doubt that it is a post under the ‘State’. In view of this pronouncement we are unable to accept the contention that “extra departmental employees are outside the purview of the terms of reference of our Commission”

STAND TAKEN BY DEPARTMENT OF POSTS IN DO LETTER No.17-13/2014-GDS dated 17-02-2014 ADDRESSED TO DEPARTMENT OF PERSONNEL & TRAINING – 

“The demand for inclusion in 7th CPC based on the definition of the expression ‘Central Govt. Employees adopted by 4th Central Pay Commission in para 1.11 of the report “as all persons in the Civil Services of the Central Government or holding Civil Posts under the Government and paid out of the consolidated fund of India” and its observations in para 1.17 & 1.18  - besides Apex Court’s judgement dated 22-04-1977 in the matter of Superintendent of Post Offices Vs. P.K.Rajamma regarding Gramin Dak Sevak services (earlier called Extra Departmental Agents) as holders of the civil post outside the regular civil service”….. 4th Central Pay Commission has categorically stated in para 1.10 that the expression ‘Central Govt Employees’ has not been defined in the Constitution or any other Law. It thus seems appropriate, if this term is duly defined based on which a final view over the inclusion of Gramin Dak Sevaks with in the purview of 7th CPC becomes possible”

Now it is learnt that the ‘ inclusion of GDS in the purview of 7th CPC’ rejected by MoF.

DoP Proposed to constitute a separate committee for GDS.

With this again we are going to face the dark age of another span of 10 years.

PROVIDENT FUND INTEREST RATE 2015-16 FIXED AT 8.7%

MINISTRY OF FINANCE

            Government Decides to Fix Interest Rates at 8.7% for General Provident Fund(GPF) and other Similar Funds Including Special Deposit Scheme, 1975(SDS,1975) for Non-Government Provident, Superannuation and Gratuity Funds for the Financial Year 2015-16.

            It was decided by the Government to link the interest rates of State PFs (General Provident Fund and other similar funds) including Special Deposit Scheme, 1975 (SDS, 1975) for Non-Government Provident, Superannuation and Gratuity Funds for the FY 2015-16 to Public Provident Fund (PPF) rates. In pursuance of that decision, the Government has decided to fix the rates 8.7% per annum applicable to the following:-

·         The General Provident Fund (Central Services).
·         The Contributory Provident Fund (India).
·         The All India Service Provident Fund.
·         The State Railway Provident Fund.
·         The General Provident Fund (Defence Services).
·         The Indian Ordnance Provident Fund.
·         The Indian Ordnance Factories Workmen’s Provident Fund.
·         The Indian Naval Dockyard Workmen’s Provident Fund.
·         The Defence Services Officers Provident Fund.
·         The Armed Forces Personnel Provident Fund.
           
         The rate of interest is applicable to the above funds w.e.f. 1st April, 2015 and until further orders.

Recently, the Government had kept the interest rates for PPF and other Small Savings Schemes intact.  However, interest rates for 5 year Senior citizen Saving Scheme and Sukanya Samriddhi Account Scheme have been increased from 9.2 to 9.3% and 9.1 to 9.2% respectively, keeping in view the commitment of the Government towards the welfare of the girl child and the senior citizens.    DSM/KA : 21.04.2014

Now EPIC or Aadhaar document enough to get PAN card


An EPIC or Aadhaar document will now be enough for any individual to obtain PAN card as the Income Tax Department has relaxed the cumbersome procedure of having multiple documents to prove one's own identity. 

The Central Board of Direct Taxes (CBDT), the apex policy making body of the I-T Department, has recently issued a notification making the Elector's Photo Identity Card (EPIC) and Aadhaar, issued by the Unique Identification Authority of India, valid proof of "date of birth" for obtaining PAN card. 

Till now, both these photo ID cards were only considered as valid proof for substantiating the "identity" and "address" of an individual and not their date of birth. 

"The new notification, in simple terms, means that henceforth having only an EPIC or Aadhaar will be enough a document for any individual to obtain the PAN card. 

"These two documents will be valid as the proof an individual's identity, address and date of birth, thereby reducing the cumbersome procedure of having multiple documents to prove one's own identity. The EPIC and Aadhaar are now unique and all purpose identifiers," a senior I-T department officer told PTI. 

As part of the new notification, the government has also made a "photo identity card issued by the central government or state government or central public sector undertaking or state public sector undertaking or the central government health service scheme photo card or ex-servicemen contributory health scheme photo card" as the valid proofs for establishing the date of birth of an individual. 


"So, effectively now, there are a total of 12 identity documents which could be used to establish the date of birth of an individual who is applying for a PAN card as compared to the eight earlier. But for a common man, who is not in government service, only an EPIC or Aadhaar is required," the officer explained. 

The officer said this new arrangement has been made possible as the government has embarked on a mission to bring the three unique identifiers - EPIC, Aadhaar and PAN - on one platform and have inter-links between their databases in order to thwart attempts of duplicity or forgery in any of these three documents which are the most essential when it comes to taking legitimate benefits of government schemes. 

PAN is a ten-digit alphanumeric number, issued in the form of a laminated card, by the Income Tax Department, to any person who applies for it or to whom the department allots the number without an application. 

The EC and the Income Tax Department had recently made announcements that they would be sharing their respective databases and getting on-board with the Aadhaar platform, whose numbers have swelled to 76.83 crore till February 15 this year. 

An individual has to apply, either manually or electronically, with copies of proof of identity, address and date of birth along with the application form to obtain a PAN whose government stipulated fee is Rs 105. 

The EPIC and Aadhaar fulfil all the three mandatory requirements.

In November, 2014, the Prime Minister has launched an Aadhaar-based biometric verification system “Jeevan Pramaan” to enable pensioners to submit a digital Life Certificate on-line. This is an important step in realising the vision of Digital India. This facility has been provided in addition to the other existing methods of submitting Life Certificate.

2. “Jeevan Pramaan” aims at sparing the pensioners and family pensioners the trouble of visiting bank or any other pension disbursing agency for submission of Life Certificates. It is possible to submit the Life Certificate from personal computers and laptops or by visiting a conveniently located Common Service Centre. Further, banks will ensure authenticity of pension and other payments by linking Aadhaar number with bank accounts and PPO numbers.

3. All the pensioners/family pensioners are, therefore, advised to get themselves and their family members registered for Aadhaar and furnish this information to the Pension Disbursing Authority. This exercise may be completed at an early date so as to avoid inconvenience at the time of submission of Life Certificate in November, 2015.

The JCM(NC), JCM Constitutents including INDWF jointly prepared the memorandum on pay Structure, Pay determination, Allowances, leave, women issues, LTC, TA/DA and Retirement benefits etc., on 30.06.2014. Similarly, on behalf of INDWF, we have submitted matters relating to Defence Civilian Employees on service matters on 28.07.2014.
