POSTAL JOINT COUNCIL OF ACTION DECIDES TO GO FOR INDEFINITE STRIKE DURING THE THIRD WEEK OF FEBRUARY 2015. DATE OF STRIKE WILL BE DECLARED IN THE
2014 DECEMBER 4TH PARLIAMENT MARCH

Government and Postal board are totally negative and insensitive towards the demands of five lakhs Postal and RMS employees including Gramin Dak Sewaks and Casual, Part-Time Contingent employees.

Dear Friends and Comrades,

Meeting of the Postal Joint Council of Action was held on 11.11.2014 at New Delhi. Shri D. Theagarajan, Secretary General, FNPO presided. Com. R. N. Parashar, Secretary General, NFPE presented agenda items for discussion. General Secretaries of affiliated Unions/Associations of NFPE & FNPO attended. Com. M. Krishnan, Ex-Secretary General of NFPE was also present in the meeting. PJCA reviewed the progress in settlement of 39 points charter of demands submitted to Secretary, Department of Posts on 28.08.2014. PJCA came to the unanimous conclusion that not even a single issue is settled by the Government and Department. Employees are suffering but authorities are turning a deaf year towards their genuine demands. Rome is burning but Neros are fiddling.

None of our demand is unjustified. Five lakhs Postal and RMS employees including Gramin Dak Sewaks and Casual, Part-time, contingent employees cannot remain as mute spectators. There is a limit for our patience. Government and Postal Board are treating our patience as our weakness.

Taking into consideration all the above aspects, the PJCA unanimously took the following decision.
1.      Entire five lakhs employees of the Department of Posts will go on indefinite strike from the third week of February 2015, if the demands are not settled before 31.12.2014.
2.      The date of the indefinite strike will be declared in the 4th December 2014 Parliament March.
3.      Every effort should be made by all All India/Circle/Divisional Unions to ensure maximum participation of employees in the Parliament March. Minimum 20000 employees should participate in the March. All should bring flags and banners.
4.      Leaders of INTUC, CITU, AITUC & JCM National Council staff side will be invited to address the Parliament March.
5.      Next PJCA meeting will be held on 03.12.2014 at 5 PM to decide the date of indefinite strike.

Let us march ahead with Determination and courage. This is time to show your sincerity towards the cause of five lakhs employees of the Department of Posts. Let us make the parliament March a Historic success. Let us unite together and make the indefinite strike a Thundering success. Let the Government and Postal Board understand that we are not Dumb-Driven cattle. We are workers and not beggars.

Ref: -   Your office letter F. No. 9-10/1997-SP (SR Section) dated 29.10.2014.

Please refer to your office letter cited above wherein Action taken Report on the items included in the Charter of demands submitted by PJCA on 28.08.2014 is furnished. Actually the Charter of Demands submitted by us on 28.08.2014 contains 39 items. Charter of Demands attached to our earlier letter dated 01.08.2014 intimating the decision of PJCA contained only 38 items. But when memorandum is submitted on 28.08.2014 the following item was also added as item no. 39.

Item No. 39 -  Revise Postmen/Mail Guard/MTS Recruitment Rules. Stop open market recruitment. Restore seniority quota promotion.

This item was earlier discussed in the JCM (DC) and it is assured by Secretary (Posts) that the Recruitment Rules will be reviewed after one or two Recruitment/Promotional exam are over, as DOP&T may not approve immediate revision of Recruitment Rules already approved by it. Now more than two Postmen/MG/MTS recruitment/examination is over and hence it is requested to take action to revise the Recruitment Rules and stop open quota recruitment. Entire vacancies may be earmarked for GDS and Casual Labourers as existed in the pre-revised Recruitment Rules.

You are requested to include the above mentioned item also in the charter of demands and “Action Taken Report” may be furnished on the above item also.

Meeting of the Postal Joint Council of Action held on 11.11.2014 reviewed the reply given by the Department to the Charter of demands submitted by PJCA on 28.08.2014 and also the progress made in settling the demands.

The PJCA meeting came to the unanimous conclusion that not even a single demand is settled and no positive approach in settling the demands is reflected in the action taken report. The PJCA is totally disappointed to read the reply. Discontentment among employees are growing day by day. Further it is noted that as many as 58 items submitted for discussion in the JCM (Departmental Council) was disallowed even without giving an opportunity to the staff side to explain the position on each case.

In view of the above position the Postal Joint Council of action unanimously decided to further intensify the agitational programmes. Accordingly the following decisions are taken.

1.      Entire five lakhs employees of the Department of Posts shall go on indefinite strike commencing from the third week of February 2015.

2.      Date of commencement of the indefinite strike will be declared in a massive Parliament March to be held on 4th December 2014. 20000 Postal and RMS employees including Gramin Dak Sewaks and Casual, Part-Time, Contingent employees will participate in the Parliament March, which will be addressed by the leaders of PJCA and leaders of Central Trade Unions and JCM National Council Staff side.

MORE LOYAL THAN THE KING!!!

“Recognized” GDS Union Leader Shri Mahadevaiah who cheated three lakhs Gramin Dak Sevaks by signing “Respectful” Agreement with Government agreeing for separate committee for GDS (Not 7th pay Commission) now want to stop the functioning of AIPEU-GDS (NFPE), AIPEU Group ‘C’ (CHQ) and NFPE (CHQ). He made false complaint to DG (Vigilance) against AIPEU-GDS (NFPE). (Please see letter published below) He asked under RTI to the Department whether the journal of NFPE “Postal Crusader” and “Bhartiya Post” of AIPEU Group ‘C’ (CHQ) are registered with Registrar of news papers (Proof will be published shortly). He want to show to the Government that he is “More Loyal Than the King”. But he should understand that he is throwing stone against the mountain. He cannot prevent the rising sun, the hope and inspiration of three lakhs Gramin Dak Sewaks-AIPEU-GDS (NFPE).

Commemorative Postage Stamp on Unit Trust of India Lreleased on 12/11/2014


To mark UTI’s Golden Jubilee Year, the Hon’ble Minister of Communications and Information Technology, Shri Ravi Shankar Prasad released a Commemorative Stamp at the function held at Hotel Leela Palace in Delhi on 12th November, 2014. Ms Anjali Devasher, Member PLI, Postal Services Board, Department of Posts and Mr Leo Puri, Managing Director, UTI AMC were present on the occasion.


Commemorative Stamp on UTIUTI was set up by the Reserve Bank of India (RBI) and functioned under its Regulatory and administrative control. It commenced its operations from 1st February, 1964 with the objective of mobilizing savings of the community and providing the small investors with a means of acquiring a stake in the industrial growth of the country. The first scheme launched by UTI was Unit Scheme 64. UTI Mutual Fund is a SEBI registered mutual fund whose Sponsors are State Bank of India, Punjab National Bank, Bank of Baroda and Life Insurance Corporation of India. UTI Mutual Fund is one of the largest mutual funds in India with investor accounts of 9.58 million under its 128 domestic schemes / plans as on September 30, 2014.

On 1st February, 2014, UTI completed 50 years of its glorious journey in pioneering wealth creation. 50 years marks a major milestone in the history of UTI and its eventful journey over the past 5 decades has been chronicled in UTI’s Coffee Table Book which was unveiled on 2nd February, 2014.

1) PM Narendra Modi left for 10-Day visit to Myanmar, Australia and Fiji: Prime Minister Narendra Modi left for Myanmar on 11 November 2014, from where he will go to Australia and then visit Fiji on his way back home. As he flew out, he has again invited people to share "thoughts and ideas" on hisAustralia trip. During his 10-day foreign tour, PM Modi will hold bilateral talks with Australian Prime Minister Tony Abbott in Canberra after the annual summit of the Group of 20 of the world's biggest developed and emerging economies. The two-day G20 summit will be held in Brisbane from November 15. Mr Modi will be the first Indian Prime Minister to visit Australia since Rajiv Gandhi did in 1986. He will also be the first Indian premier to visit the south Pacific island nation of Fiji after 33 years; Indira Gandhi had last visited in 1981.

2) National Education Day 2014 celebratedNational Education Day was observed on 11 November 2014 to mark of the birth anniversary of Maulana Abul Kalam Azad. This National Education Day was 125th birth anniversary of Maulana Abul Kalam Azad. During the celebration, President Pranab Mukherjee and other ministers paid floral tributes to Azad. Prime Minister Narendra Modi saluted Azad and described him as scholar, freedom fighter and a man who devoted his life towards nation building. Maulana Abul Kalam Azad was the first education minister of India.

3) Kerala becomes first state to give Modi's Jan Dhan Yojana full shape:  Kerala became the first state in the country to achieve full coverage of bank accounts for all families as part of the Jan Dhan Yojana launched by Prime Minister Narendra Modi on Independence Day this year. Banks in Kerala opened nearly 13 lakh new accounts Under the Pradhan Mantri Jan Dhan Yojana through intensive financial literacy campaigns launched under the aegis of the State Level Banker's Committee.

4) Prime Minister Narendra Modi joined Instagram: Taking his interaction with well wishers on social media to the next level, Prime Minister Narendra Modi joined Instagram. He shared his first photo from the 25th ASEAN Summit from Nay Pyi Taw in Myanmar. Within hours of Modi posting his first image on Instagram, the Prime Minister was flooded with nearly 38,000 followers. Prior to Instagram, Prime Minister had already been reaching out to the masses through some of the most popular social media platforms like Facebook, Twitter, Google+.

5) 11 women die after sterilisation surgeries in Chhattisgarh: Eleven women died and 34 were reported critical on 11 November 2014 after undergoing “faulty” sterilisation surgeries at a government-organised family planning camp in Bilaspur district of Chhattisgarh. Eighty three women underwent the procedure in five hours at the free sterilisation camp, organised by the Bilaspur district health department on November 8, at the Nemichand Jain hospital. 

6) Indian Film Personality of the Year award for Rajinikanth: The Centre has named actor Rajinikanth as winner of the Centenary Award for Indian Film Personality of the Year. This was announced by Colonel Rajyavardhan Singh Rathore, Minister of State, Information and Broadcasting, on Tuesday. The Chennai-based actor would be receiving the honour at the 45th International Film Festival of India to be held in Goa from November 20 to 30. Social media was agog with excitement as fans posted messages congratulating their ‘Superstar’, as he is fondly known.

7) Rajiv Mehrishi appointed Finance Secretary: Economic Affairs Secretary Rajiv Mehrishi was named the new finance secretary on Tuesday, succeeding batchmate Arvind Mayaram to both posts. According to norms, the finance secretary’s designation is given to the senior-most of the five secretaries in charge of economic affairs, revenue, expenditure, financial services and disinvestment departments. If there is more than one secretary belonging to the senior-most batch, the finance secretary is chosen based on ranking in the civil list.

8) Kapil Dev and Sunil Gavaskar in Prime Minister Narendra Modi's Australian delegation: Indian cricket legends Kapil Dev and Sunil Gavaskar have been invited by Prime Minister Narendra Modi to be part of the official delegation for the Australia tour in mid-November. In what seems to be a smart cricket diplomacy, the former captains will accompany the PM-led delegation to three Australian cities -- Sydney, Canberra and Melbourne.


9) Microsoft drops Nokia name with Lumia 535: Microsoft has unveiled a cheaper smartphone, costing about 110 euro ($135), as it eyes emerging and other low-cost markets for growth. The new model is the first Lumia smartphone under Microsoft’s own brand name. The company has released a few Lumia models since it bought Nokia’s phone business this year, but those models still carried the Nokia brand. The Lumia 535 Windows smartphone will have a 5-inch screen, as measured diagonally. It comes with 5-megapixel front and rear cameras, which should snap sharper selfies than typical smartphones.

NOTIFICATION

New Delhi, the 31st October, 2014

G.S.R. 769(E).- In exercise of the powers conferred by the proviso co article 309 and clause (5) of article 148 of the Constitution, and after consultation with the Comptroller und Auditor General of India in relation to persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules further to amend the Central Civil Services (Classification, Control and Appel) rules 1965 namely—

1. (I) These rules may be called the Central Civil Services (Classification, Control and Appeal) (Second Amendment) Rules, 2014.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Central Civil Services (Classification. Control and Appeal) Rules, 1965 (hereinafter referred to as the said rules)

(a) In rule I5, for sub-rules 2A, 3 and 4, the following sub-rules shall be substituted, namely: —

3) (a) In every case where it ta necessary to consult the Commission, the Disciplinary Authority shall forward or cause to be forwarded to the Commission for its advice:
(i) a copy of the report of the Inquiring Authority together with its own tentative reasons for disagreement, if any, with the findings of Inquiring Authority on any article of charge; and
(ii) comments of Disciplinary Authority on the representation of the Government servant on the Inquiry report and disagreement note, if any and all the cue records of the inquiry proceedings.
(b) The Disciplinary Authority shah forward or cause to be forwarded a copy of the advice of the Commission received under clause (a) to the Government savant, who shall be required to submit, if he so desires, his written representation or submission to the Disciplinary Authority within fifteen days, on the advice of the Commission

(4) The Disciplinary Authority shall consider the representation under sub-rule (2) and/ or clause (b) of sub-rule (3), if any, submitted by the Government servant and record its findings before proceeding further in the matter as specified in sub-rules (5) and (6).

(5) If the Disciplinary Authority having regard to its findings on all or any of the articles of charge is of the opinion the any of the penalties specified in clauses (I) to (iv) of rule 11 should be imposed on the Government servant, it shall, notwithstanding anything contained in rule 16, make an order imposing such penalty.

(6) If the Disciplinary Authority having regard to its findings on ail or any of the articles of charge and on the basis of the evidence adduced during the inquiry Is of the opinion that any of the penalties specified in clauses (V) to (ix) of rule 11 should be imposed on the Government servant, it shall make an order imposing such penalty and it shall not be necessary to give the Government savant any opportunity of making representation on the penalty proponed to be imposed.”;

(b) In rule 16,—

(i) in sub-rule (I),-
(A) for the words, brackets and figure “sub-rule (3)”, the words, brackets and figure ‘sub-rule (5)” shall be substituted; 
(B) for clauses (d) and (e), the following clauses shah be substituted; namely: —
“(d) Consulting the Commission where such consultation is necessary. The Disciplinary Authority shall forward or cause to be forwarded a copy of the advice of the Commission to the Government servant, who shall be required to submit, if he so desires, his written representation or submission on the advice of the Commission, to the Disciplinary Authority within fifteen days; and
(e) recording a finding on each imputation or misconduct or misbehavior.” 
(ii) in sub-rule (2) for clauses (vi) and (vii), the following clauses shall be substituted,
“(vi) representation, if any, of the Government servant on the advice of the Commission:
(vii) the findings on each imputation of misconduct or misbehavior; and
(viii) the orders on the case together with the reasons therefor.;

(C) In rule 17, the words “and also a copy of the advice, if any, given by the Commission,” shall be deleted;

(d) In rule 19, in the second proviso, after the words “where such consultation ta necessary”, the words “and the Government servant has been given an opportunity of representing against the advice of the Commission.” shall be added;.

(e) In rule 27, in sub-rule (2), in the proviso, in clause (i) alter the words “where such consultation is necessary” the words “and the government servant has been given an opportunity of representing against the advice of the Commission,” shall be added:

(f) In rule 29, in sub-ruIe (1) in the first proviso, after the words “where such consultation is necessary”. the words“ and the Government servant has been given an opportunity of representing against the advice of the Commission shall be added:

(g) In rule 29-A, in the proviso, after the words “where such consultation is necessary”, the words “and the Government servant has been given an opportunity of representing against the advice of the Commission.” shall be added;

(h) In rule 32 shall be omitted.
