Manohar Parrikar, Suresh Prabhu, J P Nadda and Birendra Singh have been inducted into the Cabinet, while health minister Harsh Vardhan and railway minister Sadanand Gowda have been replaced and given lesser portfolios. Central Govt employee opts for a surrogate child – What says CCS (Leave) Rules..?



Can Central Govt Female Employees Opting for Surrogate Pregnancy Claim Maternity Leave?

Parenthood is a gift of god. Thanks to the development in medical sciences, childless couples can now opt for surrogate pregnancies. If women employees of Central Government organizations opt for surrogate pregnancies, can they claim maternity leave?

Women employees of Central Government establishments are given Maternity leave for a period of 180 days and male employees are given Paternity Leave for a period of 15 days if they choose to adopt babies. At present, there is no leave entitlements for parents of the surrogate child.

Let’s see what the Indian medical Research Council has to say about couples who choose to have babies through surrogate mothers.

Surrogacy: General Considerations

A child born through surrogacy must be adopted by the genetic (biological) parents unless they can establish through genetic (DNA) fingerprinting (of which the records will be maintained in the clinic) that the child is theirs.Guidelines for ART Clinics in India ICMR/NAMS

Surrogacy by assisted conception should normally be considered only for patients for whom it would be physically or medically impossible/undesirable to carry a baby to term.

Payments to surrogate mothers should cover all genuine expenses associated with the pregnancy. Documentary evidence of the financial arrangement for surrogacy must be available. The ART centre should not be involved in this monetary aspect.

Advertisements regarding surrogacy should not be made by the ART clinic. The responsibility of finding a surrogate mother, through advertisement or otherwise, should rest with the couple, or a semen bank.

A surrogate mother should not be over 45 years of age. Before accepting a woman as a possible surrogate for a particular couple’s child, the ART clinic must ensure (and put on record) that the woman satisfies all the testable criteria to go through a successful full-term pregnancy.

A relative, a known person, as well as a person unknown to the couple may act as a surrogate mother for the couple. In the case of a relative acting as a surrogate, the relative should belong to the same generation as the women desiring the surrogate.

A prospective surrogate mother must be tested for HIV and shown to be seronegative for this virus just before embryo transfer. She must also provide a written certificate that (a) she has not had a drug intravenously administered into her through a shared syringe, (b) she has not undergone blood transfusion; and (c) she and her husband (to the best of her/his
knowledge) has had no extramarital relationship in the last six months.

(This is to ensure that the person would not come up with symptoms of HIV infection during the period of surrogacy.) The prospective surrogate mother must also declare that she will not use drugs intravenously, and not undergo blood transfusion excepting of blood obtained through a certified blood bank.

No woman may act as a surrogate more then thrice in her lifetime

Aadhaar Enabled Biometric Attendance System for Railway employees – Railway Board Orders

Sub: Enrolment for Aadhaar Enabled Biometric Attendance System (AEBA)
Hon’ble MR has directed that all personnel of the Ministry of Railways, Rail Bhavan (including those located at Pragati Maidan) shall enroll on the Aadhaar Enabled Biometric Attendance System.
2. In this regard, the spadework for enrolment on the system has been completed by the C&IS directorate and the system is now ready to be used for user enrolment.
3. It is now required that all the personnel of Ministry of Railways working In the offices of Rail Bhawan and Pragati Maidan are to enroll themselves afresh directly on the website http://attendance.gov.in/regester/employee
4. For the said enrolment process, all the Section Officers are responsible for enrollment of staff, including MTS and others working under them and the officers of the level of Under Secretary/Deputy Directors and above may enrol themselves on the website on their own. After registration, all EDs shall forward a list of the personnel enrolled n their Directorate giving the information to C&IS through email as per annexure in a spreadsheet via email. Officers above the level of SAG may send their report directly through their PPS/Sr.PPS/PSO.
5. The detailed process for enrolment is enclosed which may be followed while enrolling. The said process of enrolment of all officers/staff under AEBAS should be completed latest by 18.10.2014 (Saturday).

Subject: Applicability of Old Pension Scheme to Substitutes who attained temporary status prior to 01.01.2004 but regularized after 01.01.2004 – clarification regarding.
The issue of coverage of substitutes who had attained temporary status prior to 01.01.2004 but regularized after 01.01.2004 under Old Pension Scheme, has been raised by both the recognized Federations (AIRF & NFIR) under PNM/AIRF item No.05/2012 and PNM/NFIR item No.15/2011 respectively. The issue has also been raised under DC/JCM (Railways) item No.20/2012.
2. The issue has been examined by Board and it has now been decided that substitutes who got temporary status prior to 01.01.2004 but regularized/absorbed after 01.01.2004 and after regularization, if the date of appointment is prior to 01.01.2004, in terms of provision of Board’s letter No.E(NG)ll/90/SB/Master Circular dated 29.01.1991(M.C. No.20/91) and para 6 of letter No.E(NG)11/2008/SB/SR/15 dated 17.09.2010, then they may be covered under Old Pension Scheme.
3. Further, the employee and employer contribution of the NPS corpus of the Substitutes, mentioned in para 2 above, who so far have been covered under the National Pension System (NPS) may be adjusted in terms of the instructions contained in Board’s letter No.2010/AC-II/21/18 dated 31.03.2014(RBA No.5/2014)

No improvement in IBAs offer – UFBU decides to go ahead with the strike on 12.11.2014

Conciliation meeting held by CLC today(5.11.2014) – No improvement in IBAs offer – CLC calls for further meeting on 10th instant – UFBU decides to go ahead with the strike
Further to the Strike notice served on the IBA by the UFBU, conciliation meeting was held today in New Delhi by Mr. P.P. Mitra Chief Labour Commissioner, Ministry of Labour, Government of India. IBA was represented by Mr. M.V. Tanksale, Chief Executive, Mr. Unnikrishnan, Dy. Chief Executive and other officials. UFBU was represented by all the constituent unions.
During the conciliation proceedings, the IBA contended that due to the reducing profitability of the Banks, they are unable to accept the demands of the UFBU and stated that for the sake of an amicable settlement, they would be willing to consider improving their present offer provided UFBU agrees to substantially reduce the demands. IBA also suggested that UFBU should defer the strike so that the negotiations may be further continued.
On behalf of the UFBU, we explained the reasonability and justification of our demands and stated that the IBAs offer falls too short of our expectations and hence not at all acceptable. We further stated that looking to the runaway inflation as well as the increasing stress and workload under which bank employees and officers are working now-a-days, we deserve adequate wage revision. We also said that besides improvement in emoluments and service conditions, other demands like 5 day banking, regulated working hours for officers, improvement in pension scheme, extending the old pension scheme to the newly recruited employees, etc. are also needed to be resolved but the IBA is not forthcoming on these issues.
IBA informed that they are willing to continue the negotiations further and appealed to the UFBU to defer the strike to facilitate a better atmosphere. UFBU informed that the strike call has been forced on the Unions due to the unhelpful approach and unacceptable offer of the IBA and reiterated its preparedness for further negotiations provided IBA would come forward with substantial improvement in their offer.
After hearing both sides, the Chief Labour Commissioner suggested that both IBA and the UFBU should take steps to reconcile the differences and reach an amicable settlement. He further advised the IBA to talk to the UFBU to find out how the strike could be averted. He also adjourned the conciliation proceedings to 3-00 PM on 10th November, 2014 for further discussions.
Thus, our demands remained unresolved and UFBU decided to go ahead with the strike. Hence, we call upon all our constituent unions and members to march on to 12th November 2014 strike withouut any let up.

Action against Government Servants who get appointment on the basis of false SC/ST/OBC certificates.

Sub:- Action against Government servants who get appointment on the basis of false SC/ST/OBC certificates.


The undersigned is directed to invite reference to this Department’s OM No.11012/7/91-Estt.(A) dated 19.5.1993 which provides as under:-

"Wherever it is found that a Government servant, who was not qualified or eligible in terms of the recruitment rules etc., for initial recruitment in service or had furnished false information or produced a false certificate in order to secure appointment, he should not be retained in service. If, he is probationer or a temporary Government servant, he should be discharged or his services should be terminated. If he has become a permanent Government servant, an inquiry as prescribed in Rule 14 of CCS (CCA) Rules, 1965 may be held and if the charges are proved, the Government servant should be removed or dismissed from service. In no circumstances should any penalty be imposed".

2. The position was reiterated vide this Department’s OM No.42011/22/2006-Estt.(Res.) dated the 29th March, 2007 that the cases other than those protected by the specific order of the Apex Court should be dealt with in accordance with the instructions contained in the aforesaid O.M. However, it has been observed that disciplinary proceedings in the cases involving appointments on the basis of false/fake caste certificates take considerable time and the persons who have secured employment on the basis of false caste certificates enjoy the benefits of Government service whereas such Government servants should be removed / dismissed from the service at the earliest.

3. It is requested that disciplinary enquiries involving the matter of securing jobs on the basis of false/fake certificates should be completed in a time bound manner and unscrupulous persons who have got appointment on the basis of fake/ false caste certificates should not be retained in service and should be dismissed / removed thenceforth.

4. Contents of this OM may be brought to the notice of all concerned.

Appointment on Fake Caste Certificates

Information about appointments secured on the basis of fake/false caste certificates is not centrally maintained.

However, the Central Government had taken one time exercise to collect information about appointments secured on the basis of fake/false caste certificates in the year 2010. As per information received from various Ministries/Departments etc., 1832 appointments were allegedly secured on the basis of fake/false caste certificates. Disciplinary proceedings had been instituted in all the cases. It was reported that out of the above 1832 cases, 276 had been resulted in suspension/removal etc., whereas 521 cases were entangled into litigations and in remaining 1035 cases disciplinary proceedings were pending.

The Government instructions provide that an appointing authority should verify the caste status of SC/ST/OBC candidates at the time of initial appointment as well as every important upturn of the employee’s career.

Chief Secretaries of States/Union Territories have been requested to issue instructions to the District Magistrates/District Collectors/Deputy Commissioners of the Districts to the effect that when asked to verify the veracity etc. of caste certificates, they should ensure at their own level that veracity of the caste/community certificate referred to the district authorities is verified and reported to the appointing authority within one month of receipt of request from such authority. In order to rule out collusion between candidates holding false/forged certificate and employees at the district level or sub-district level, disciplinary proceedings may be initiated against officers who default in timely verification of caste status in such cases or issue false certificates.

This was stated by Shri V. Narayanasamy, Minister of State in the Ministry of Personnel, Public Grievances and Pension and Minister of State in the Prime Minister’s Office in written reply to a question by Shri Aayanur Manjunatha in the Rajya Sabha.
 

DIAMOND JUBILEE CELEBRATIONS OF NFPE AT GUWAHATI


Regional Co-Ordination Committee of Postal Employees union of Assam & N.E Circle, Guwahati organised “Diamond Jubilee Celebration” of National Federation of postal Employees (NFPE) on 3rd & 4th Nevember’14 at Meghdoot Bhawan Postal Recreation Club  with various programmes. .

Today on 3rd Nov’14 the programme started at 9-45 a.m. with hoisting of flag of mighty NFPE followed by garlanding to the Matrys’ column. At 10 a.m. veteran trade union leaders of the state (total 18) were felicitated. A Seminar was held at 11a.m. on   “Future of India Post in the Era of  Globalistion” wherein Sri Riju Ganguli,IPS , Director of Postal services ,Assam was the Chief Guest & Com. M.Krishnan Ex. Secy. General, NFPE & Secy General of  All India Confederation ofCentral Govt.  employees & workers , N.Delhi was the  Speaker. The seminar was presided over by Com.L.P.Saikia President, RCC of postal employees unions of Assam & N.E.

At 2-30 p.m. glorious 60 yrs  history of  struggle of NFPE union for the cause of entire central Govt. Employees & workers, particularly postal employees of the country was elaborately narrated  by Com. M. Krishnan , Secy. General of  All India Confederation of Central Govt. Employees & Workers, New Delhi  In his speech he reminded the major achievement , major struggles, sacrifices by the leaders & workers & guide lines for future course of action for achievement of the pending demands. A book on the struggle of 1960 strike in regional language written by Com. S.Rahman Ex. Convenor RCC was published & released by RCC Assam & N.E, Guwahat  iCom.G.Talukdar, AGS, R-III union & Secy Staff Side of Postal Unions of Assam circle spoke on the glorious struggling history of NFPE Assam. Vote of thanks by Com. D.K.Debnath, Convenor,RCC.

On 4th November from 9.45 a.m. art competition among the children of Postal Employees (total participation was 20) was held in the same place . From 11-30 a.m. a debate among the young activists was held on the subject “Necessity of participation in trade union” wherein also there was 12 participant. Com. M.Krishnan concluded the debate with  a very educative  speech. Again after the lunch from 3.00 p.m. a health camp was  organised with the help of  “Elora Vigyan Mancha”  Guwahati  wherein another seminar on the  Awareness on Cancer  disease”  organised & Dr. Munindra Narayan Baruah, Managing Director, North East Cancer Hospital & Research Institute, Guwahati  was the chief speaker.  7 Comrades namely com. D.K.Debnath Convenor, R.C.C, his wife Com.Kajal Debnath, Com Sajer Rahman, Ex. Convenor, RCC, Com.G.Talukdar, AGS,-RIII & his wife Com.Ratna Talukdar, Com. Sukumar Baishya SA, Com.
