Payment of DA on Pension of Ex-Servicemen

Guidelines issued by the Department of Pension and Pensioners Welfare for payment of Dearness Relief to re-employed pensioners have been extended by this Ministry to the ex-servicemen re-employed in civil posts. These guidelines are as under:-

  • The pay of re-employed pensioners who held posts of the ranks of Commissioned Officers at the time of their retirement is fixed at the same stage as last drawn before their retirement. These pensioners are not entitled to any Dearness Relief on pension on their re-employment in civil posts.
  • The pay of re-employed pensioners who held posts below the ranks of Commissioned Officers (PBOR) at the time of their retirement is fixed at the minimum of the pay scale of the post in which they are re-employed. Such pensioners are entitled to Dearness Relief on pension on their re-employment in civil posts.
  • If the pay of re-employed pensioners who held posts, below the ranks of Commissioned Officer (PBOR) at the time of their retirement before attaining the age of 55 years, is fixed at a higher stage because of advance increments and no protection of the last pay drawn is being given, the pay is treated as fixed at a minimum of the pay scale for the purposes of ignoring the entire pension and allowing Dearness Relief on pension.

It is expected that the aforesaid guidelines are being implemented by all banks uniformly without prejudice to the ex-servicemen category. This information was given by Defence Minister Shri Arun Jaitley in a written reply to ShriMahendra Singh Mahrain Rajya Sabha today.

In its second phase of interaction, the Commission plans to hold meetings in different parts of the country to facilitate stakeholders staying in various areas to present their views personally before the Commission and ensure larger representation. This exercise is being undertaken to enable the Commission to get a firsthand impression about the functioning and the condition of service prevailing in different parts of the country.

Accordingly, the Commission, headed by its Chairman, Justice Shri A. K. Mathur, proposes to visit Bengaluru between 24th August and 26th August 2014. The Commission would like to invite various entities/associations/federations representing any/all categories of employees covered by the terms of Reference of the Commission to present their views.

(e) if so, the details thereof and if not, the reasons therefor?

ANSWER

Minister of State in the Ministry of Personnel, Public Grievances and Pensions and Minister of State in the Prime Minister’s Office. (DR. JITENDRA SINGH)

(a): The fundamental principles applicable to all Ministries/Departments regarding engagement of consultants and outsourcing of services are provided in General Financial Rules 2005. The Ministries/ Departments may hire external professionals, consultancy firms or consultants for a specific job which is well defined in terms of content and time frame for its completion or outsource certain services. A Ministry/Department may outsource certain services in the interest of economy and efficiency and it may describe detailed instructions for this purpose. As the respective Ministries/ Departments are empowered to outsource certain services on their own, no centralized data is maintained.

(b)&(c): Engagement of contract labourers is regulated under the Contract Labour (Regulation & Abolition) Act. The Central Government is the appropriate Government in respect of the establishments falling in central sphere. The interest of contract labourers in terms of wages and other service conditions are safeguarded under this Act. As far as the security in term of wages is concerned, as per Rule 25(2)

(v)(a) of the Contract Labour (Regulation & Abolition) Central Rules, 1971 , the wages of the contract labour shall not be less than the rates prescribed under Minimum Wages Act, 1948 and in cases where the contract workers perform the same or similar kind of work as the workmen directly employed by the principal employer of the establishment, the wage rates, holidays , hours of work and other conditions of service shall be the same as applicable to the workmen directly employed by the principal employer doing the same or similar kind of work. The liabilities to ensure payment of wages and other benefits is primarily that of the contractor and, in case of default, that of the principal employer.

The Social Security aspects of contract labourers under Employees Provident Fund and Miscellaneous Provision Act, 1952 and Employees state Insurance Act, 1948 are enforced by the Employees Provident Fund organization and Employees State Insurance Corporation respectively provided the establishments in which contract labourers are working are covered under the said Acts.

In the Central sphere, the Central Industrial Relations Machinery (CIRM) has been entrusted with the responsibility of enforcing the provisions of the Act and rules made thereunder. Aggrieved workers may raise their issues, if any, before the Appropriate Authority under Labour laws.

(d)&(e): The Social Welfare Schemes of the Government are also applicable to the Contract Labourers if they fulfil the conditions of the Scheme to be eligible for the benefits of a particular Scheme. However, the interests of Contract Workers are protected specifically under Contract Labour (Regulation & Abolition) Act, 1970.

Some of the prominent social welfare legislations are as follows:-

# Payment of Gratuity Act, 1972
# Employees’ Provident Fund & Misc. Provisions Act, 1952
# Employees’ Pension Scheme, 1995
# Employees’ State Insurance Act, 1948

Onus of confirmation lies with the Central Government employees

In Parliament Dopt Minister Shri Dr.Jitendra Singh said in a written reply to a question on 5.8.2014 regarding confirmation of Central Government employees after probationary period.

He said, the onus of confirmation lies with the Organisation concerned. As per the extant instructions on satisfactory completion of the period of probation or extension thereof, the Government i.e the employer/Organisation may confirm a temporary Government servant from the date of completion of the period of probation or extension thereof.

As per extant instructions, the confirmation of a Government Servant is delinked from the availability of permanent vacancy in the grade. In other words, an officer who has successfully completed the probation, as prescribed under relevant rules, may be considered for confirmation.

Under Rule 23 of Central Civil Services (Classification, Control & Appeal) Rules, 1965, an employee has the right to appeal against any Order which denies or varies to his disadvantage his pay, allowances, pension or other conditions of service as regulated by rules or by the service agreement.

As per extant instructions save for exceptional reasons, probation should not be extended for more than a year and in no circumstance an employee should be kept on probation for more than double the normal period.
