CAT and High Court : Government Staff can't avoid Transfers


CAT as well as the Madras high court rules that Government employees can't avoid transfers. The ruling states that "a government servant holding a transferable post has no vested right to remain posted at a particular place".


The division bench of the court comprising Justice R Banumathi and Justice TS Sivagnanam was passing orders on a petition filed by PR Anand Kumar, an army engineer who entered the Military Engineering Services as surveyor assistant in 1985. The post was re-designated as junior engineer. Anand was transferred from Chennai to Visakhapatnam on November 8, 2011. Anand had made a request to the army to be retained in Chennai which was rejected. Anand then approached the CAT. Citing paragraph 36(b)(c) of the transfer guidelines, the CAT said he ought not to have been transferred in the middle of an academic year. It asked the authorities to pass fresh orders if necessary. 


The initial order was withdrawn owing to CAT ruling. But he was transferred to Hyderabad by an order dated February 10, 2012. He again rushed to CAT, which dismissed his application this time. He then moved the high court. 


Rejecting his petition, the judges said: "The scope of judicial review of orders of transfer is well settled. The high court, while exercising its jurisdiction under Article 226, is not expected to go into the question as to whether the transfer was for public service, as it would essentially require factual adjudication and depend upon the peculiar facts and circumstances of the case." 


"Therefore, unless an order of transfer is shown to be an outcome of mala fide exercise or stated to be in violation of statutory provisions, the courts or the tribunals normally cannot interfere with such orders as a matter of routine," they said. 


Though the guidelines deal with time of transfer and state that care will be taken to avoid transfers during the middle of the academic year, exceptions are available to meet requirements, the judges said. Transfers on administrative grounds may be ordered giving the employee less time, they said. 


"There is no challenge to the order of transfer on the ground of any malafide exercise of power or that the order of transfer was passed by an incompetent authority or it violated any statutory rule," they said of Kumar's case.

Government Website www.data.gov.in gives access to 3,500 data banks


General public can now access over 3,500 government data banks on a single website having a wealth of information, ranging from beneficiaries under various schemes to industrial output numbers.

Launching the website www.data.gov.in, Telecom and IT Minister Kapil Sibal said: "Ever since the UPA government came to power, information revolution started with the Right to Information Act that has got up to a stage where we are willing to share data with everybody. We realise that in absence of data you can not take appropriate decision."

The website carries over 3,500 government data banks, according to an officialrelease.

People in government must change their mindset and be willing to share more information barring those piece of information that can have security implications, he said.

"Even though we 3500 sets of data, what we need to do is change mindset of governments throughout the country to share all that data. Unless we share information we will not be able to bring revolution," the Minister said.

Adviser to Prime Minister of India, Sam Pitroda said: "Today we have over 3,500 sets of data but in next six months we would like to see that this goes up to 10,000 data sets and we would like to challenge developer community to make at least 100 applications in next month to use this data."

The union cabinet on Thursday approved a proposal to set up a state-owned all-women’s bank with an initial corpus of Rs. 1,000 crore, paving the way for setting up a financial institution dedicated to women in general, and women Self-Help Groups (SHGs) in particular.

The proposed bank is likely to begin operations by November this year.

The proposal to set up the Bharatiya Mahila Bank was first announced by finance minister P Chidambaram's in this year’s budget speech in February.

According to sources, the government expects the bank to turn profitable by 2019. It plans to set to open 100 branches within that period.

Minister of state for finance Namo Narain Meena had told the Rajya Sabha on Wednesday that the government is planning to seek Parliament's nod for allocation of funds for setting up the bank.

Government has finalised the proposal to start the Bharatiya Mahila Bank Limited with 6 branches, one each in North, South, East, West, Central and North Eastern parts of India, sources said.

The initial cadre of about 125 officers of the new women-focussed bank will be selected on deputation from other public sector banks, sources said.

A proposal to increase the retirement age of government employees from 60 to 62 years came to the Cabinet on Thursday but a decision was deferred. The government might make the announcement in the Prime Minister’s Independence Day address, his last before general elections in 2014. The ministry of personnel, public grievances and pensions has proposed an increase in retirement age of government employees from 60 to 62 years, top sources confirmed.

There are around five million central government employees in India. The previous occassion the government raised the retirement age of central government employees was in 1998, from 58 to 60 years. The move is meant to ease the financial burden on the government in terms of its pension liabilities, sources said.

The retirement age of professors in all central universities was recently raised to 65 years. D L Sachdev, national secretary of the All India Trade Union Congress, said his union was totally against the increase of the retirement age beyond 60. It would hurt the youth, especially when the government is doing nothing to create jobs for them, Sachdev said.

Congress-affiliated Indian National Trade Union Congress national president Sanjeeva Reddy said his union had been demanding increase in the retirement age to 62 years and would welcome it.

Minister for Personnel, Public Grievances and Pensions V Narayanaswami had ruled out an increase in the retirement age to a question in Parliament in the winter session this year. An official in the ministry, when asked, refused to speak about it.
